<br /> 146 <br /> TAX ABATEMENT AGREEMENT BETWEEN <br /> THE CITY OF SAN MARCOS, AND <br /> BUTLER MANUFACTURING COMPANY, INC. <br /> STATE OF TEXAS <br /> COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS <br /> CITY OF SAN MARCOS <br /> , <br /> This tax abatement agreement (this "Agreement") is entered into between the City of San <br /> Marcos, Texas, (the "City") a Texas municipal corporation, and Butler Manufacturing Company, Inc., a <br /> Delaware corporation ("Butler"). <br /> I. <br /> GENERAL PROVISIONS <br /> A. This Agreement is authorized by the Property Redevelopment and Tax Abatement Act, <br /> Chapter 312 of the Texas Tax Code. <br /> , <br /> B. This Agreement is governed, also, by the City of San Marcos' Guidelines Governing <br /> Tax Abatement and Other Economic Development Incentives, as adopted and amended by the City <br /> Council. <br /> C. Butler is the owner of the 28.68 acre tract of property situated in Hays County, Texas, <br /> l- which is the subject of this Agreement (the "Property"), the legal description of which is attached to this <br /> Agreement as Exhibit "A". The Property is wholly within .the City of San Marcos Enterprise Zone duly <br /> -- <br /> designated under the Texas Enterprise Zone Act, and is within the city limits of the City of San Marcos. <br /> D. The Property is not part of an improvement project financed by tax increment bonds. <br /> E. This Agreement is entered into subject to the rights of the holders of outstanding bonds <br /> of the City. <br /> F. The Property is not owned or leased by any member of the San Marcos City Councilor <br /> any member of the City Planning and Zoning Commission. <br /> G. All proposed improvements, described in Section 2 below shall conform to all applicable <br /> City ordinances and regulations, including but not limited to the City's Construction Codes, Master Plan, <br />
