<br /> . - ., <br /> )Jf/\ <br /> -14- <br /> ARTICLE 12 <br /> OTHER DUTIES AS SET FORTH IN CONSTRUCTION CONTRACT DOCUMENTS <br />12.1 ARCHITECT will have such other duties and <br />responsibilities and limitations of authority as agreed to by <br />ARCHITECT in writing and as are set forth in the construction <br />contract documents for the Project. However, in the event of <br />conflictl dispute, or discrepancy between the provisions of this <br />Agreement and the construction contract documents I the more <br />restrictive and/or burdensome provisions will govern and control. <br /> ARTICLE 13 <br /> BASIS OF COMPENSATION <br /> The CITY will compensate the ARCHITECT for the Scope of <br />Services provided, in accordance with Article 51 Payments to the <br />ARCHITECT I and the other terms and conditions of this Agreement, <br />as follows: <br />13.1 BASIC COMPENSATION <br />13.1.1 For Basic Services as described in Sections 1.0-1.31 the <br />ARCHITECT will be compensated at a rate of 7.5% of the <br />Construction Budget. The Construction Budget for Phase 1 is <br />defined as the budget which is established by the CITY at the <br />beginning of the Project. For Phase 2, the Construction Budget is <br />defined as the scope of work approved by the CITY at the end of <br />the Design Development stage and based on the ARCHITECT/s opinion <br />of probable cost as specified in subsection 1.1.2. For Phase 3 I <br />the ARCHITECT's final opinion of probable cost as specified in <br />subsection 1. 2.2 will fix the Construction Budget I regardless of <br />the actual cost of construction. The ARCHITECT/s establishment of <br />the Construction Budget for Phases 2 and 3 is subject to review <br />and approval by the CITY. <br />13.1.2 Compensation will be made to the ARCHITECT by the CITY <br />in accordance with Article 5, Payments to the Architectl so that <br />compensation for each phase of these services equals the following <br />portion of the amount of the Construction Budget: <br /> Phase 1 - Schematic Design 15% <br /> Phase 2 - Design Development I 20% <br /> Construction Documents 40% <br /> Bidding 5% <br /> Phase 3 Construction Administration 20% <br />13.2 COMPENSATION FOR ADDITIONAL SERVICES <br />13.2.1 Compensation for additional services of the <br />ARCHITECT I as described in Section 1.4, shall be computed based on <br />the ARCHITECT's standard hourly rates: <br /> Principal $ -95 per hour <br />
