<br />~ ~ - <br />"... ~ S!: .,~ ~. 4 7 <br />u"""" -, <br />U! ð -:. =::Æ ORDINANCE 1994 - 83 <br />U -b ~ ':J ~ <br />-J~ .~:?,~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />tU~ ~ ï:=~ MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE <br />. <if, QQ FOR THE 1994-1995 FISCAL YEAR TO INCREASE THE <br />NUMBER OF POLICE OFFICERS IN THE PATROL DIVISION OF <br />THE POLICE DEPARTMENT BY ONE¡ AMENDING SECTION 2-31 <br />OF THE SAN MARCOS CODE OF ORDINANCES TO INCREASE <br />THE NUMBER OF POSITIONS WITHIN THE CLASSIFICATION <br />OF POLICE OFFICER TO 30 AND TO INCREASE THE NUMBER <br />OF POSITIONS WITH THE CLASSIFICATION OF CORPORAL <br />TO 16 ¡ PROVIDING FOR SEVERABILITY ¡ REPEALING ALL <br />CONFLICTING ORDINANCES¡ PROVIDING FOR PUBLICATION¡ <br />AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. In accordance with Section 8.16 of the City <br />Charter of the City of San Marcos, Texas, the City Council <br />declares that a public necessity exists which requires <br />amendment of the City's 1994-95 budget. <br />.' . <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the City Budget for the 1994-95 is <br />amended as shown in the attached Exhibit A to increase the <br />number of authorized police officers in the Patrol Division <br />of the Police Department by one. ~ <br /> <br />SECTION 2. That Section 2-31 of the Code of <br />Ordinances is amended to increase the number of authorized <br />positions within the classification of Police Officer from 24 <br />positions to 30 positions and to increase the number of <br />authorized positions within the classification of Corporal <br />from 14 positions to 16 positions. <br /> <br />SECTION 3. That if any word, phrase, clause, <br />sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by. a court of competent <br />jurisdiction, the remaining provisions of this ordinance <br />shall remain in effect as if the unconstitutional or invalid <br />portion had not been adopted. <br /> <br />SECTION 4. That all ordinances and resolutions or <br />parts of ordinances or resolutions in conflict herewith are <br />hereby repealed. <br /> <br />SECTION 5. That the importance of this <br />Ordinance creates an emergency and an imperative public <br />necessity so that the prOVlSlons of the Charter requlrlng <br />that ordinances shall be presented at three separate meetings <br />and that no ordinance shall become effective until the <br />expiration of ten (10) days following the date of its final <br />passage be suspended, and these provisions are hereby <br />suspended, and this Ordinance shall take effect and be in <br />full force and effect from and after its adoption and after <br />its publication in a newspaper of general circulation within <br />the City as provided by the City Charter of the City of San <br />Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 28th day of <br /> <br /> <br />November, 1994. l~~fVl~ <br /> <br />Mayor <br />Attest: Approved: <br />c--f( íVr~: '(J¡;MN.~) ~<O ~ <br /> <br />J¡~is K.
