INTERLOCAL AGREEMENT <br />This Interlocal Agreement is entered into by and between Texas State University -San <br />Marcos ( "Texas State ") and the City of San Marcos, Texas (the "City ") under the authority of the <br />Texas Interlocal Cooperation Act, Chapter 791 of the Texas Government Code. <br />I. Recitals <br />1.01. Texas State is a public university that provides transportation services, including <br />bus service within the boundaries of the City, for its students, special events and for various <br />higher education related activities. <br />1.02. The City maintains a transportation system within its jurisdiction to include the <br />operation and maintenance of streets, sidewalks and public right -of -way. Bus service is provided <br />to residents of the City through an interlocal agreement between the City and Capital Area Rural <br />Transportation System ( "CARTS "). <br />1.03. The City and Texas State wish to eliminate duplication of resources and to <br />provide for a more efficient allocation of transportation resources by coordinating some of their <br />overlapping transportation activities including siting and construction of bus stops. <br />1.04. The purpose of this Agreement is to delineate the roles and contributions of the <br />parties with regard to the development of bus stops. The activities of the parties under this <br />Agreement are governmental as defined in §791.003 of the Texas Government Code. <br />1.07. For the reasons above, the parties enter into this a (the "Agreement ") under the <br />terms and conditions below. <br />II. Coordination and Cost Participation Regarding Bus Stops <br />2.01. Coordination of Activities. After execution of this Agreement, the parties agree <br />that, when a party proposes the location and construction or modification of a bus stop and <br />related improvements, that party will contact the other and, in such event, the parties agree to <br />cooperate with each other to negotiate a mutually agreeable location, design and cost for such <br />bus stop and related improvements. <br />A. Authorized Representatives. For all activities and approvals under this <br />Agreement, the City Manager, or his designee shall be the authorized representative of <br />the City, and the Director, Transportation Services, or his/her designee shall be the <br />authorized representative of Texas State. This Agreement does not waive or supersede <br />any limitations on the spending or decision - making authority of the authorized <br />representatives under applicable laws, directives, orders or resolutions. <br />B. Agreement. If the parties reach agreement regarding a proposed bus stop, <br />the agreement shall address: <br />the location of the bus stop; <br />2. the nature and specifications for improvements, including signage; <br />3. the costs of design and construction; <br />4. the party responsible for designing and constructing the <br />improvements directly or through use of contractors; <br />
