<br />æ¡ g: ~§ <br />.0 je. - ;-~ 77 <br />h1 g - ,- # r:: <br />~ (J .- <br />,- a", <br />~ \ O¡ c u..J. 0-:. <br />,.... <:I en <br />~~ ~ §i ORDINANCE 1994-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 3, ANIMALS AND FOWL, OF THE SAN <br />MARCOS CODE OF ORDINANCES BY AMENDING THE DEFINITION OF <br />COMMERCIAL ANIMAL ESTABLISHMENT AND ZOOLOGICAL PARK, AND <br />BY ADDING A DEFINITION OF GOVERNMENT OPERATED FACILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Sec. 3-1 of the San Marcos Code of Ordinances is amended by <br />changing the definition of commercial animal establishment to read as follows: <br /> <br />Commercial animal establishment means any pet shop, grooming shop, auction, <br />riding school or stable, zoological park, kennel or small animal facility, guard dog or <br />obedience training center, circus or performing animal exhibition. This term shall not <br />include animal shelters, veterinary hospitals or government operated facilities as <br />those terms are herein defined. <br /> <br />SECTION 2. That Sec. 3-1 of the San Marcos Code of Ordinances is amended by <br />changing the definition of zoological park to read as follows: < <br /> <br />Zoological park means any place or facility where wild animals are kept for the <br />purpose of display or exhibition. <br /> <br />SECTION 3. That Sec. 3-1 of the San Marcos Code of Ordinances is amended by <br />addition of the following definition: <br /> <br />Government operated facility means any facility owned or operated by a <br />governmental entity at which animals are handled, kept or displayed. <br /> <br />SECTION 4. That if any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion <br />had not been adopted. <br /> <br />SECTION 5. That all ordinances and resolutions or parts of ordinances or resolutions <br />in conflict herewith are hereby repealed. <br /> <br />SECTION 6. That any person violating any provision of this ordinance shall be deemed <br />guilty of a misdemeanor and upon conviction shall be subject to the penalty provided in <br />Section 1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 7.
