(16) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Prather, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2013 -13R, as previously captioned. The motion carried <br />Public Hearing <br />20.7:OOPM Receive a Staff esentation and hold a public hearing to recei <br />ff ve comments for <br />or against an appeal filed by Mr. Berry James regarding the issuance of a Conditional <br />Use Permit to Zelicks Inc. for on- premises consumption of alcoholic beverages; and <br />consider afore mentioned appeal. <br />Matthew Lewis, Director of Development Services, provided a brief presentation on the history <br />of this item. <br />Mayor Daniel Guerrero opened the Public Hearing at 8:33 p.m. <br />Barry James, 323 W. Hopkins, addressed the Council regarding the CUP that was presented to <br />Zelicks, Inc and asked for a moratorium on live music at this location. He stated that there is no <br />process in getting demerits on their points on their CUP regarding noise violations and would <br />like to see one. <br />Mike Dillion, 1000 Burleson, addressed the Council regarding the CUP and the fact that the <br />music was not addressed. He asked that the Council send it back to Planning and Zoning to work <br />out. <br />Brenda Smith, 323 W. Hopkins St, addressed the Council and the issues that Zelicks has <br />presented with recent live music performances. She asked that the volume be turned down and <br />that the matter be sent back to P &Z for further discussion. <br />Chase Katz, 366 W. Hopkins, addressed the appeal letter and provided answers to the <br />accusations made by Mr. James. <br />Seth Katz, 336 W. Hopkins, addressed the Council regarding the letter and provided answers to <br />the accusations that were made against Zelicks. He stated that Crystal River Inn and Zelicks <br />came to an agreement and this could nullify the current agreement they have. He also stated that <br />Mr. James has never contacted them regarding issues he addresses in his letter. <br />Cathy Dillion, 1000 Burleson, addressed the Council as the co -owner of Crystal River Inn. She <br />addressed the specific negotiations that had been made with Zelicks. She stated that no one ever <br />discussed live music as a regulation and that it created an unintended consequence of allowing <br />bands to potentially go until 2am. She asked the Council to send it back Planning and Zoning. <br />There being no further comments; the public hearing was closed at 8:51 p.m. <br />MOTION: Upon a motion made by Council Member Becak and a second by Council Member <br />Scott, the City Council voted six (6) for and (1) opposed, Council Member Prather, to push the <br />
