<br />:e -=:T- >.-i 88 <br />°1 ;: ffi ;! <br />Ul <3 .~ =- <::: <br />- . c:..;) <br />=:91 ~ ~~: ORDINANCE 1994 - 90 <br /> <br />,-Wi Ëi 8B A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS ABANDONING AND VACATING A <br />PORTION OF CORNELL STREET LOCATED ADJACENT TO <br />LOTS 7A, 8A AND 8B OF BLOCK 7 OF THE <br />MacNAUGHTON ADDITION; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE QUITCLAIM DEEDS TO THE <br />ABUTTING PROPERTY OWNERS; AND DECLARING AN <br />EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. The MacNaughton Addition appears of record in the Deed <br />Records of Hays County, Texas, in Book 551 Page 593 and a replat <br />of a portion of this addition adjacent to Cornell Street appears <br />in Volume 41 Page 211 of the plat Records of Hays County, Texas. <br /> <br />2. The replat of this addition shows a portion of the right-of- <br />way for cornell Street to be located adjacent to Lots 7A, 8A and <br />8B of Block 7 of the addition as shown as shaded area on the <br />attached map. <br /> <br />3. 'The City of San Marcos has been requested by the abutting <br />property owners, Dr. Francis Horne and Southwest Texas State <br />University to abandon this portion of Cornell Street. <br />. <br />4. The City of San Marcos has determined that it is in the <br />public interest to abandon this portion of Cornell Street to the <br />abutting property owners. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the right-of-way for Cornell Street as shown <br />as shaded area on the attached map is vacated and abandoned as to <br />any usel right, claim in, or responsibility for the upkeep and <br />maintenance by the public in general and the City of San Marcos in <br />particular. <br /> <br />SECTION 2. That upon payment to the City of the fair market <br />value of the right-of-way being abandoned, and submission of <br />survey descriptions of the portions of this right-of-way to be <br />conveyed to each of the abutting property owners, the City Manager <br />is authorized to execute Quitclaim Deeds for the respective <br />portions to the abutting property owners. <br /> <br />SECTION 3.
