<br /> * Contract amended see Resolution dated January 9, 1995. <br /> 106 <br /> RESOLUTION 1994- 191 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br /> OF AN AGREEMENT BETWEEN THE CITY AND THE <br /> SOUTHWEST TEXAS STATE UNIVERSITY SUPPORT <br /> FOUNDATION FOR PURCHASE OF THE RIO VISTA DAM AND <br /> ADJACENT PROPERTY; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council approved an application to the Texas Parks and Wildlife <br /> Department for the San Marcos Park and Wildlife Habitat Phase 1/ Project in Resolution <br /> 1993-141 R. <br /> 2. The City Council desires to enter into an agreement with the Southwest Texas <br /> State University Support Foundation for the purchase of the property and water rights that <br /> will be the site of this project. <br /> , <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Agreement attached to this <br /> Resolution between the City and the Southwest Texas State University Support Foundation <br /> for purchase of the Rio Vista Dam and adjacent property, are approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is authorized to execute this <br /> Agreement on behalf of the City. <br /> PART 3.
