<br />AN ORDINANCE OF THE CiTY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY ZONING LOTS 4, 5 AND
<br />6, BLOCK 3 AND LOTS 4, 5 AND 6, BLOCK 6 OF THE
<br />BLANCO GARDENS SUBDIVISION OF THE CITY OF SAN'
<br />MARCOS,, TEXAS, AS RECORDED IN VOLUME 1, PAGE 1
<br />OF THE HAYS COUNTY PLAT RECORDS, LOCATED AT
<br />1306, 1307, 1308, 1309, 1310 AND 1311 BARBARA
<br />DRIVE FROM "C" COMMERCIAL DISTRICT TO "DP-2"
<br />TWO-FAMILY DWELLING DISTRICT (MEDIUM DENSITY)
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br /> WHEREAS, on September 29, 1992, the Joint P~anning and Zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to change the zoning from "C" Commercial
<br />District to "DP-2"Two-Family ~welling District (Medium Density) for
<br />Lots 4, 5 and 6, Block 3 and Lots 4, 5 and 6, Block 6 of the Blanco
<br />Gardens Subdivision of the City of San Marcos, Texas located at
<br />1306, 1307, 1308, 1309, 1310 and 1311 Barbara Drive; and,
<br />
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning Commission did, on September 29, 1992 consider the request
<br />and voted to approve it and has recommended that the request be
<br />approved by the City Council of the City; and,
<br />
<br /> WHEREAS, the City Council held a public hearing on the llth
<br />day of January , 1993, regarding the request; and,
<br />
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br /> WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br /> SECTION 1. That the Official Zoning Map of the City, as
<br />described in Section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "C"
<br />Commercial District to "DP-2" Two-Family Dwelling District (Medium
<br />Density):

<br />LOTS 4, 5 AND 6, BLOCK 3 AND LOTS 4, 5 AND 6, BLOCK 6 OF
<br />THE BLANCO GARDENS SUBDIVISION OF THE CITY OF SAN MARCOS,
<br />TEXAS, AS RECORDED IN VOLUME 1,~PAGE 1 OF THE HAYS COUNTY
<br />PLAT RECORDS, LOCATED AT 1306, 1307, 1308, 1309, 1310 AND
<br />1311 BARBARA DRIVE.

<br /> SECTION 2. That this Ordinance shall be in effect ten (10)
<br />days from and after its Passage and after.it has been subject to
<br />reconsideration by the Council at its next regular meeting
<br />following its passage, and provided that the Council did not vote
<br />to reconsider it. If reconsidered on January 25, 1993 it shall be
<br />in effect ten days from and after its passage on that date if
<br />approved. It shall not go into effect if denied. If not
<br />reconsidered and approved it shall be published in 'a newspaper of
<br />general circulation in the area as required by the Charter of the
<br />City of San Marcos, Texas.

<br /> PASSED, APPROVED AND ADOPTED this ilth day of January , 1993,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for January 25, 1993
