STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />· , 1992, by and <br /> <br />NH 92(10)M <br />0016-09-025 <br />Hays County <br /> <br /> THIS AGREEMENT, made this llth day of January <br /> <br /> etween the City of San Marcos, hereinafter called the "City", Party of the First <br /> Part, acting by and through its City Manager and the State of Texas, hereinafter <br /> called the "State", Party of the Second Part, acting by and through its State <br /> Department of Transportation Commission. <br /> <br /> WI~EREAS, the City desires the installation of five dual 'mast arm illumination <br /> standards at Southwest Texas State University Bobcat Stadium within the right of <br /> way from Station 1508+25.51 to Station 11568+81 on Loop 82, as shown in Field <br /> Change No. 4 (Attachment A), and the City has requested the State to construct or <br /> have constructed this work. The State will construct or have constructed this <br /> work for and on behalf of the City at the City's sole expense, excluding <br /> preliminary engineering. The estimated construction cost of this work amounts to <br /> Five Thousand Two Hundred Twenty-Eight and 29/100 Dollars ($5,228.29), including <br /> <br /> ontingencies and construction engineering. <br /> <br />..... NOW THEREFORE, it is understood that this proposed work will be constructed <br /> by the State and the City will transmit to the State with the return of this <br /> agreement, executed by the City, a w~rrant or check made payable to the Texas <br /> Department of Transportation in the amount of Five Thousand Two Hundred Twenty- <br /> Eight and 29/100 Dollars ($5,228.29), to be used in paying for the proposed work <br /> required by the City in the City of San Marcos. It is further understood that the <br /> State will construct only those items for the City as requested and required by <br /> <br /> <br />
