REIMBURSEMENT AGREEMENT <br /> <br /> THIS REIMBURSEMENT AGREEMENT ("Agreement") is made and entered <br />into and effective this ~ day of Janua='¢ , 199.~, by and <br />between Sprint Communications Company Limited Partnership (hereinafter <br />referred to as "Sprint"), whose mailing address is 8140 Ward Parkway, <br />Kansas City, Missouri 64114, and the City of San Marcos, of the State of <br /> ~., <br />Texas, (hereinafter referred to as "City"). ,,,~ <br /> <br /> WHEREAS, the City in conjuncbon w~th the State of <br />perform work on Loop 82, from Interstate Highway 35 to Bugg'%~Lane in the <br />City of San Marcos, Texas. " <br /> WHEREAS, the City desires Sprint to pedorm certain fiber optic <br />cable modification work, within the existing easement, in accordance <br />with the attached Exhibit A, and incorporated herein; and, <br /> WHEREAS, Sprint, under the terms hereinafter state~, is willing to <br />evaluate said improvements and to perform certain fiber optic cable <br />modification work to accommodate such work provided City reimburses <br />Sprint for all of its actual costs, both direct and indirect, of making such <br />modifications. <br /> NOW, THEREFORE, in consideration of the promises and mutual <br />convenants herein contained, Sprint hereby agrees to perform ce~ain fiber <br />optic cable modification work in accordance with the attached Exhibit A <br />subject to the following terms and provisions: <br /> <br />City agrees that Exhibit A represents the Scope of Work requested of <br />Sprint. <br /> <br />City shall, at its own expense, inspect any construction by Sprint <br />hereunder, to assure itself that Sprint work is being performed in <br />compliance with the needs of the City. <br /> <br />City agrees to bear all direct and indirect costs incurred by Sprint and <br />relating to any construction by Sprint hereunder, including, but not <br />limited to, labor, materials, construction, damages, administrative <br />overhead, taxes and legal fees relating to the engineering and <br />modification of the fiber optic cable to accommodate the work. <br /> <br /> <br />
