<br /> ('E\ ~~ 93 <br />.. -::E (r- <br />tl~ :L <t:'"" <br />d ¡..-<:Q <br />U w:li <br />\ù~ \i\ 5<:::: ORDINANCE fJ% f ~...8' <br />t..p::> - wt! <br />'W~ VJ- <br /> ¿: ¡:::c <br /> <:::: <br /> --:> -.B> <br />~:¡j !;.ôt£Ð <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE CITY CODE OF <br /> ETHICS TO PROVIDE FOR THE ADMINISTRATION OF <br /> OATHS AT HEARINGS OF THE ETHICS REVIEW <br /> COMMISSION; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES; PROVIDING <br /> FOR PENALTIES; PROVIDING FOR PUBLICATION; AND <br /> PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, the Ethics Review Commission has recommended that the <br /> city Code of Ethics be amended to provide for the administration of <br /> oaths at hearings conducted by the commission; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That subsection (c) of section 2-93 of the San <br /> Marcos Code of Ordinances is hereby amended to add subdivision (4) <br /> to read as follows: <br /> (4) The chair of the commission, or any person acting in <br /> that capacity, and the recording secretary of the <br /> commission, are authorized to administer oaths to <br /> persons 'who testify at hearings cORducted by the <br /> commission. . <br /> SECTION 2. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 4. That any person violating any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor and upon <br /> conviction shall be subject to the penalty provided in section 1-5 <br /> of the San Marcos Code of Ordinances. <br /> SECTION 5.
