VERAMENDI <br />';e, L.I... 58 SURVEY NO.2, HAYS COUNTY, TEXAS, CONSISTING <br />OF 12.2 ACRE, 20.0 ACRE AND 40.00 ACRE <br />TRACTS OF LAND, DESCRIBED, RESPECTIVELY, IN <br />DEEDS TO THE CITY OF SAN MARCOS DATED DECEMBER <br />30,1967 AND RECORDED IN VOLUME 221, PAGE 371, <br />DATED APRIL 23, 1982 AND RECORDED IN VOLUME <br />374, PAGE 249, AND DATED JULY 26, 1982 AND <br />RECORDED IN VOLUME 378, PAGE 558, ALL IN THE <br />HAYS COUNTY DEED RECORDS, LOCATED ON THE <br />SOUTHEAST SIDE OF THE 700 BLOCK OF RIVER ROAD <br />FROM "PD" PRE-DEVELOPMENT DISTRICT TO "P" <br />PUBLIC AND INSTITUTIONAL DISTRICT AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on October 27, 1992, the Joint Planning and Zoning <br />commissions of the city of San Marcos held a public hearing <br />regarding a request to change the zoning from "PD" Pre-Development <br />District to "P" Public and Institutional District of 72.2 acres of <br />land area situated in the J.M. Veramendi Survey No."2, Hays County, <br />Texas, consisting of 12.2 acre, 20.0 acre, and 40.00 acre tracts of <br />land described, respectively, in deeds to the City of San Marcos <br />dated December 30, 1967 and recorded in Volume 221, Page 371, dated <br />April 23,1982 and recorded in Volume 374, Page 249, and dated July <br />26, 1982 and recorded in Volume 378, Page 558, all in the Hays <br />County Deed Records, located on the Southeast Side of the 700 Block <br />of River Road from "PD" Pre-Development District to "P" Public and <br />Institutional District, and; <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />Zoning commission did, on October 27; 1992 consider the request and <br />voted to approve' it and has recommended that the request be <br />approved by the city Council of the city; and, <br /> <br />WHEREAS, the city Council held a public hearing on the 1st <br />day of March, 1993, regarding the request; and, <br /> <br />WHEREAS, all requirements of Appendix A, General Zoning <br />Ordinance, of the Code of Ordinances of the city of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, the city Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as <br />described in Section 3 of the General Zoning Ordinance is hereby <br />amended to rezone the following described real property located on <br />the Southeast side of the 700 Block of River Road in San Marcos, <br />Hays County, Texas, which is presently zoned "PD" Pre-Development <br />District to "P" Public and Institutional District: <br /> <br />TRACT J.: <br /> <br />All that certain tract or parcel of land containing 12.2 <br />acres, more or less, si tuated in the Juan Martin de <br />Verimendi League, A-17-2, Hays County, Texas, and being <br />also a part of 100.13 acres, more or less, conveyed to <br />Frank F. Sharp by B.F. Harper, et aI, by deed dated <br />August 9, 1947, and recorded in Volume 138, Page 628, of <br />the Deed Records of Hays County, Texas. Said 12.2 acres, <br />more or less, is more fully described by metes and bounds <br />as follows: <br />
