24 J,j RESOLUTION 1993- 44 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN EXCHANGE OF PROPERTY ALONG AND ADJACENT TO PROSPECT STREET BETWEEN THE CITY AND MOSTYN ENTERPRISES, INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE A, QUITCLAIM DEED, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City has made a public offer to exchange two tracts of property along Prospect Street for other similar tracts of property along Prospect street useable for right-of-way purposes, in accordance with Local Government Code Section 272.001(a); and, WHEREAS, an offer has been submitted by Mostyn Enterprises, Inc. to exchange a 0.25 acre tract of property for the 0.08 and 0.11 acre tracts of property offered by the City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the exchange of 0.08 and O.ll~acre tracts of property by the city for a 0.25 tract of property by Mostyn Enterprises, as described in the metes and bounds descriptions in the deeds attached hereto as Attachments 1 and 2, is approved. PART 2. That the city Manager, Larry D. Gilley, is authorized to execute the Quitclaim Deed attached hereto as Attachment 1 and to exchange the deed for the Warranty Deed attached hereto as Attachment 2 executed by Mostyn Enterprises, Inc.
