<br /> 51 <br /> RESOLUTION 1993-57 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE DEEDS AND CLOSING DOCUMENTS <br /> IN CONNECTION WITH THE CITY'S AFFORDABLE <br /> HOUSING PROGRAM AND THE CITY'S TEXAS COMMUNITY. <br /> DEVELOPMENT PROGRAM CONTRACT NO. 700068 WITH <br /> THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY <br /> AFFAIRS; AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the city and the Texas Department of Commerce <br />(succeeded as to this contract by the Texas Department of Housing <br />and Community Affairs) entered into Community Development Program <br />Contract No. 700068 for an affordable housing program on January <br />15, 1991; and, <br /> WHEREAS, the city has completed the construction of five homes <br />at 201, 203, 205, 207 and 209 Armstrong Street in San Marcos under <br />the affordable housing program; and, <br /> WHEREAS, the city is the owner of the lots upon which these <br />homes were constructed, and the sale of the homes ~ill need to be <br />accompanied by the conveyance of the lots, in accordance with the <br />City's commitment to donate the lots as part of its contribution to <br />the program; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the conveyance of lots lA, 4A, 6A, 8A and 11A of <br />Block 7 of the First Section of the Victory Gardens Addition to the <br />city of San Marcos, as shown on the replat thereof filed at Volume <br />5, Page 332 of the Hays County Plat ~ecords, in connection with the <br />City's affordable housing program is determined to serve a public <br />purpose within the meaning of that term in section 272.001(g) of <br />the Texas Local Government Code, and the conveyance of such lots <br />and the improvements thereon for less than fair market value is <br />hereby approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is hereby <br />authorized to execute deeds and other closing documents for the <br />sale of the lots described in Part 1 above to qualified purchasers, <br />for prices determined to be appropriate through consultation with <br />the Texas Department of Housing and Community Affairs. <br /> PART 3. That this Resolution shall be in full force and <br />effect immediately from and after its passage. <br /> ADOPTED this 22nd day of Ml~' 1993. . <br /> at y ~o~J.
