<br /> 53 <br /> RESOLUTION 1993 - 59 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS r TEXAS AUTHORIZING INITIATION OF <br /> CONDEMNATION PROCEEDINGS AGAINST THE FREEMAN <br /> EDUCATIONAL FOUNDATION TO ACQUIRE A .2296 ACRE <br /> PARCEL FOR A WATER TANK PAD SITEr A .350 ACRE <br /> TEMPORARY CONSTRUCTION EASEMENT SURROUNDING <br /> THE PAD SITEr A .350 ACRE PIPELINE EASEMENT <br /> AND A .611 ACRE PUBLIC UTILITY EASEMENT IN <br /> CONNECTION WITH THE NORTHWEST WATER SYSTEM <br /> IMPROVEMENTS PROJECT IN THE CITY OF SAN <br /> MARCOSr TEXAS¡ AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREASr the City Council of the City of San Marcosr Texas <br />has determined that the Northwest Water System improvements are <br />required for the preservation of the public healthr safety and <br />welfare and the public convenience and necessity in the City of <br />San Marcos, Texas¡ and, <br /> WHEREAS, the necessary improvements require acquisition by <br />the City of San Marcos of .2296 acres of land in fee simple as a <br />water tank pad siter a .350 acre temporary construction easement <br />surrounding the pad site, a .350 acre pipeline easement and a .611 <br />acre public utility easementr currently owned by the Freeman <br />Educational Foundation and more fully described in Exhibit A <br />attached hereto and incorporated herein for all purposes; andr <br /> WHEREAS, the City of San Marcos has previously attempted to <br />negotiate in good faith for the purchase of said propertYr andr <br /> WHEREASr the City of San Marcos has been unable to acquire <br />this property by purchase notwithstanding said negotiations; nowr <br />therefore <br /> , <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOSr <br />TEXAS: <br /> PART 1. That the land more fully described in Exhibit A <br />attached hereto and incorporated herein for all intents and <br />purposes is necessary and essential for the completion of the <br />Northwest Water System improvements in the City of San Marcos, <br />Texas. <br /> PART 2. That the Northwest Water System improvements are <br />required for the preservation of the public healthr safety and <br />welfare and the public convenience and necessity. <br /> PART 3. That the City AttorneYr Mark B. Taylor is hereby <br />authorized to cause the initiation of condemnation proceedings for <br />the acquisition of said property no later than April 9r 1993r 3:00 <br />p.m. <br /> PART 4.
