<br /> 61 <br /> RESOLUTION 1993 - 60 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS EXPRESSING THE CITY'S <br /> POSITION ON PENDING STATE LEGISLATION <br /> PERTAINING TO THE EDWARDS AQUIFER; AND <br /> DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />- PART 1. That the City of San Marcos supports the following <br />bills pending before the 73rd Texas Legislature pertaining to the <br />Edwards Aquifer: <br /> (a) HB 1792 by Linebarger and Puente/SB 1320 by Barrientos, <br />Madia, Wentworth and Luna - Relating' to the creation of the <br />Edwards Water Resource Management Authority - Support for the <br />management plan for the Edwards contained in this bill is <br />conditioned on the ability of the Authority to obtain a permit <br />from the U.S. Fish and wildlife Service under Section 10(a) of the <br />federal Endangered Species Act. <br /> (b) HB 1316 by Puente - Relating to the drilling of artesian <br />wells. <br /> PART 2. That the City of San Marcos opposes the following <br />bills pending before the 73rd Texas Legislature pertaining to the <br />Edwards Aquifer: <br /> (a) HB 207 by Puente - Relating to appropriation of state <br /> water for recharge of the Edwards Aquifer. <br /> (b) HB 1216 by Nieto - Relating. to the validation of the <br /> Uvalde County Underground Water Conservation District. <br /> (c) HB 1308 by Counts - Relating to the Texas Water <br /> Commission's authority to regulate groundwater. <br /> I <br /> (d) HB 2254 by Hilderbran - Relating to the definition of <br /> subterranean streams and the ownership of groundwater. <br /> (e) HB 2540 by Puente - Relating to the abolition of the <br /> Guadalupe-Blanco River Authority. <br /> (f) HB 2643 by Counts/SB 1207 by Sims - Relating to the <br /> development of water resources and granting authority to <br /> the Texas Water Development Board. <br /> (g) HB 2785 by Counts - Relating to the management of spring <br /> flow from the Edwards Aquifer. <br /> (h) HB 2801 by Hilderbran - Relating to the regional <br /> management of the Edwards Aquifer. <br /> (i) SB 74 by Bivins - Relating to the rule-making <br /> authority of the Water Commission regarding underground <br /> water. <br /> (j) SB 158 by Carriker - Relating to authority to regulate <br /> underground water. <br />f <br /> (k) HCR 52 by Hilderbran - Relating to the Endangered <br /> Species Act. <br /> PART 3.
