Section 30-100(i) shall be added to the City Code <br />and shall read as follows: <br /> <br />. < <br /> <br />(i) If an industrial user takes action to reduce the input "' <br />of pollutant materials into the sewer system and <br />requests the City in writing to collect and analyze an <br />additional sampler the costs of such supplemental <br />sampling will be borne by the industrial user. Sample <br />analytical costs to be paid by the industry shall <br />include the charge to the City by the commercial <br />laboratory performing the analysis r plus a fee to the <br />Ci ty for sample collection and delivery to the <br />laboratory by City staff. This fee shall be set by <br />separate ordinance. <br /> <br />SECTION 3. Section 30-100(j) shall be added to the City Code <br />and shall read as follows: <br /> <br />(j) Billing for industrial waste surcharges r sampling and <br />testing shall be as follows: <br />~ <br />(1) The due date for all bills shall be the fifteenth <br />day following the date of issuance. The penalty <br />date shall be the twentieth day following the date <br />of issuance. <br /> <br />(2) A bill shall be considered delinquent if the full <br />amount of the bill is not paid by the due date. A <br />bill is considered paid if the paYment is either <br />received by the City or postmarked by the postal <br />service no later than the due date. <br /> <br />I <br /> <br />(3) A penalty service charge of ten per cent (10%) shall <br />be assessed against the portion of the delinquent <br />bill that is not paid before the penalty date. <br /> <br />SECTION 4. That if any word, phraser clauser sentencer or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdictionr the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 5. That all ordinances or parts of ordinances in <br />conflict with this ordinance are hereby repealed. <br /> <br />SECTION 6. That any person who violates any provision of <br />this ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty prescribed in Section <br />1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 7. That this Ordinance shall be in effect ten (10) <br />days from and after its passager and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcosr Texas. <br /> <br />PASSED AND APPROVED on first reading M~rch 22, 1993 <br /> <br />PASSED AND APPROVED on second reading April 12,1993. <br /> <br />PASSED, APPROVED AND ADOPTED April 26, 1993. ¡f\A.
