This limitation of DIGITAL's liability will apply <br />regardless of the form of action, whether in contract or tort including <br />negligence. Any action against DIGITAL must be brought within the time period <br />governed by the laws of the State of Texas. Limitations of liabilities are <br />granted only to the extent allowed by the laws and Constitution of the State of <br />Texas.
