<br /> IOI/) <br />this Lease Agreement. Subsequent total yearly payments shall be made <br />on the anniversary date of this Agreement. <br /> VIII. <br /> SUB-LEASE OR LEASE TRANSFER <br /> It is expressly understood and agreed that the Lessee may not <br />sub-lease any part of the leased property nor may the Lessee transfer <br />the Lease Agreement to another party without the prior written consent <br />of the Lessor. Consent to such sub-lease or trans fer may be given by <br />Lessor only if the third party agrees, in writing, to accept and abide <br />by all of the provisions of this Lease Agreement. <br /> IX. <br /> DEFAULT AND/OR RECAPTURE <br /> It is understood and agreed that the United States Government has <br />certain rights with respect to the property hereby leased, and that it <br />is possible that a situation may arise in which, through no fault of <br />either party hereto, it may be necessary that this Lease Agreement be <br />terminated. In such event, Lessor shall refund to Lessee the prorata <br />share of a~y prepaid lease money on the property involved. With regard ,.' <br /> I <br />to any provision of this Lease Agreement, it is understood that the <br />United States Government has an interest in the property hereby leased, <br />and that a national emergency or some other unforeseen condition may <br />require that the possession of said property be surrendered to the <br />United States Government or to an agency thereof, prior to the end of <br />the term of this Lease Agreement. In such termination, Lessor shall <br />make reasonable efforts on behalf of Lessee to secure payment for the <br />value of investments and/or of growing crops from the United States <br />Government. <br /> This Lease Agreement and all provisions thereof shall be subject <br />and subordinate to all the terms and conditions of the instruments and <br />iocuments under which the Lessor acquired said property from the United <br />3tates of America, and shall be given such effect and construction as <br />will not conflict or be inconsistent with such terms or conditions. <br /> In the event either party should violate any term or provision of <br />this Lease Agreement, the party not in default shall give the <br />defaulting party notice thereof, and if such default complained of <br /> -5- <br />
