<br /> 13()F <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> ARTICLE I <br /> DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> Section 1.01. Definitions. <br /> Unless otherwise expressly provided or unless the context <br /> clearly requires otherwise, in this Ordinance the following terms <br /> shall have the meanings specified below: <br /> The term "Additional Parity Bonds" means the additional parity <br /> revenue bonds and obligations which the City reserves the right to <br /> issue in the future, as provided in this Ordinance. <br /> "Bond" means any of the Bonds. <br /> "Bonds" means the City's bonds entitled "City of San Marcos, <br /> Texas, Electric Utility System Revenue Refunding Bonds, Series 1993" <br /> in the aggregate principal amount of $15,955,000 authorized to be <br /> issued by Section 3.01 of this Ordinance. <br /> "Closing Date" means the date of the initial delivery of and <br /> payment for the Bonds. .. <br /> "Code" means the Internal Revenue Code of 1986, as amended, <br /> including applicable regulations, published rulings and court <br /> decisions relating thereto. <br /> "Designated Payment/Transfer Office" means (i) with respect to <br /> the initial Paying Agent/Registrar named herein, its corporate trust <br /> office in Dallas, Texas, and (2) with respect to any successor <br /> Paying Agent/Registrar, the office of such successor designated and <br /> located as may be agreed upon by the City and such successor. <br /> , <br /> "DTC" shall mean The Depository Trust Company of New York, New <br /> York, or any successor securities depository. <br /> "DTC Participant" shall mean any broker, dealer, bank, trust <br /> company, clearing corporation or certain other organizations with <br /> Bonds credited to an account maintained on its behalf by DTC. <br /> "Escrow Agent" means Arneritrust Texas National Association. <br /> "Escrow Agreement" means the escrow agreement, dated as of <br /> May 10, 1993, by and between the City and the Escrow Agent. <br /> "Escrow Fund" means the fund referred to in Sections 8.06(b) <br /> and 10.01 of this Ordinance and established by the Escrow Agreement <br /> to hold cash and securities for the payment of principal of and <br /> interest on the Refunded Bonds. <br /> 4588f <br /> -2- <br />
