II will make aV"dilable all of the facilities of the airport developed with federal financial <br /> as.~istance and all those usable for landing and takeoff of aircraft to the United Statcs for use by Government aircraft in <br /> common with other aircraft at all times without charge. e'.~ept, if th" use hy Government aircraft is substantial. charge may he <br /> made for a reasanahle share. proportional to such use. for the COSt of operating and maintaining the faeilities used. Unless <br /> otherwise determined by the Secretary, or otherwise agreed to by the sponsor and the using agency. suhstantial use of an <br /> airport hy government aircraft will he considered to exist when operations of such aircraft are in excess of those which, in the <br /> opinion of the Secretary. would unduly interfere with use of the landing areas hy other authori7.ed aircraft. or during any <br /> calendar month that-- <br /> a. Five (5) or more government aircraft are regularly based at the airport or on land adjacent thereto; or <br /> h. 'Iñe total number of movements (counting each landing as a movement) of government aircraft is 300 or more, or the gross <br /> accumulative weight of government aircraft using the airport (the total movements of government aircraft multiplied by <br /> gros.~ weights of such aircraft) is in excess of five million pounds. <br /> 28, Land for Federal Pacifiti= It will furnish without cost to the federal Government for use in connection with any air traffic <br /> control or air navigation activities, or weather-reporting and communication activities related to air traffic control, any areas of <br /> land or water, or estate therein, or rights in buildings of the sponsor as the Secretary considers necessary or desirable for <br /> construction. operation. and maintenance at federal expense of space or facilities for such purposes. Such areas or any <br /> portion thereof will he made available as provided herein within four months after rcceipl of a ""Tillenrequest from the <br /> Secretary. <br /> 29. ^irport [.ayeU! Plan. <br /> a. II will keep up to date at all times an airport layout plan of the airport showing (1) boundaries of the airport and all <br /> proposed additions therelo. together ,,'ilh the [,ound;¡ries of all offsite areas owned or controlled hy the sponsor for airport <br /> purposes and proposed additions therclO: (2) the location and nature of all existing and proposed airport facilities and <br /> Structures (such as runways, taxiways. aprons. terminal buildings. hangars, and roads). including all proposed extensions and <br /> reductions of existing airport facilities: and (3) the location of all existing and proposed nona,iation areas"and of a1l existing <br /> Improvements thereon. Such airport la)'out plan and each amendment. revision. or modification thereof. shall he subject to <br /> the approval of the Secretary which approval shall he eviden,'ed by the sig;,ature of a duly authorized n:presentative of the <br /> Secretary on the face of the airport layout plan. 'n,e sponsor \\oill not make or permit any change~or alterations in the <br /> aIrport or In any of its facilities which arc not In conformity with the airport layout plan as approved by the Secretary and <br /> which n\lglll. in the opinion of the Secrelary. ¡Idversely affect Ihe safety, utililY. or efficiency of the airport. <br /> h. If a change or alteration in the airpon or its faciilties is made which the Secrelary determines adversely affects the safety. <br /> uliilt)'. or efficiency of any Fede,.¡¡lIy o"'ned. leased, or funded property on Or off the airport and which is not in conformit)' <br /> with the airport layout plan as approved hy the Secretary. the owner or operatOr ....ill, if requested by the Secretary (1) <br /> eliminate such advel>e effect in a manner approved by the Secretary; or (2) bear all costs of relocating such property (or <br /> replacement thereof) to a site acceptahle to the Secretary and all cOStS of restoring such property (or repl¡¡cement thereof) <br /> to the le"el of safety. utility. efficiency. and cost of operation existing before the unapproved change in the airport or its <br /> lacilities. <br /> 30. Civil RighL<;. It will comply with such rules as are promulgated to assure ¡hat no person shall, on the grounds of race. creed. <br /> color, national origin. sex. age. or handicap be excluded from participatì,ng in any activity conducted with or benefiting from <br /> funds received from this grant. This assurance obligates the sponsor for the period during which Federal financial as.<istance is <br /> extended to the program, except where ¡-'ederal financial assistance is to provide. or is in the rom, of personal property or real <br /> property or interest therein or structures Or improvements thereon. in which case the assurance obligates the sponsor or any <br /> transferee for the longer of Ihe following periods: (a) the period during which the property is used for a purpose for which <br /> Federal financial assistance is extended. or for anolher purpose involving the provision of similar services or henefits or (h) Ihe <br /> period during which the sponsor retains ownership or pos.~es.~ion of the property. <br /> 31. Dispos:1l of Land. <br /> a, For land purchased under a grant for airport noise compatihility purposes. it will. when the land is no longer needed for <br /> such purposes, dispose of such land at fair market value at the earliest prdcticahle time. That portion of the proceeds of <br /> ,uch disposition whkh IS proportionate 10 the United States share of thc cost acquisition of such land will, at the discretion <br /> of the Secretary. (1) hc paid to the Se,'retary for deposit in the Trust Fund or (2) he reinvested in an approved noise ' <br /> compatibility project as prescribed by Ihe Secretary. <br /> h. (I) For land purchased under a grant for airport development (other than noise compatihility) purposes. it will. when the <br /> land is no longer needed for airport purposes. dispose of such land al fair marker value or make available to the <br /> Secretary an amount equal to the United States proportionate share of Ihe fair market value of the land. lñat portion <br /> of the proceeds of such disposition which is proportionate 10 the United States share of the cost of acquisition of such <br /> land. will, (a) upon application to the Secrelary. he reinvested in another eligible airport improvement project or <br /> projects approved by the Secretary at that airport or within the national airport system, or (b) he paid to the &cretary <br /> for deposit in the Trusl fund if no such eligible project exists. <br /> l'age70fiO <br /> ^irport ^s.~urances (II-n) I'I'-A-l <br />
