<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE RUNOFF ELECTION HELD
<br />ON MAY 22, 1993 FOR THE PURPOSE OF ELECTING A'
<br />CITY COUNCIL MEMBER, PLACE THREE AND DECLARING
<br />; AN EMERGENCY.

<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas, by
<br />ordinance duly enacted on May 3, 1993, ordered that a runoff
<br />election be held on May 22, 1993 for the purpose of electing a City
<br />Council Member, Place Three; and,
<br />
<br />WHEREAS',' notice of this election was duly published in the San
<br />Marcos Daily Record on May 7, 1993; and,
<br />
<br />WHEREAS, copies of this notice were duly posted at each city.
<br />election precinct polling place prior to the election, and a copy
<br />of the notice was posted on the bulletin board at city Hall on
<br />May 4, 1993; and,
<br />.
<br />WHEREAS, this election was duly and legally held on the 22nd
<br />day of May, 1993, in conformity with the election laws of the State
<br />of Texas, and the results of the election have been certified and
<br />returned by the proper judges and clerks thereof; and,
<br />
<br />WHEREAS, the city council of the City of San Marcos, Texas
<br />with the following members present: Kathy M. Morris, Ronald K. Hart,
<br />Billy G. Moore, Bill Plummer, Fred Guerra, Joe B. Cox
<br />and has today considered the returns of
<br />the runoff election held on the 22nd day of May, 1993; and,
<br />I
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the election was in all respects lawfully held; and,
<br />
<br />WHEREAS, it appears to the Council, and the Council so finds,
<br />that the tabulation of the results of the election is correct; now,
<br />therefore,
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the runoff City election of May 22, 1993 was
<br />duly called, that notice of the election was given in accordance
<br />with law, and that the election was held in accordance with law.
<br />
<br />SECTION 2. That the tabulation of votes cast in the runoff
<br />election held on May 22, 1993 for the purpose of electing a City
<br />Council Member, Place Three, made and certified to by the city
<br />Secretary of the city of San Marcos, a copy of which is attached
<br />hereto and made a part hereof, is hereby adopted as the official
<br />tabulation of the votes cast at the election, and that the
<br />tabulation be filed and recorded in the official records of the
<br />city of San Marcos as the official canvass of the election.

<br />SECTION 3. That the official canvass of the returns of the
<br />election reflects that the following person was duly elected City
<br />Council Member, Place Three of the city of San Marcos:

<br />SECTION 4. That the importance of this Ordinance creates
<br />an emergency and an imperative public necessity so that the
<br />provisions of the Charter requiring that ordinances shall be
<br />presented at three separate meetings and that no ordinance shall
<br />become effective until the expiration of ten (10) days following
<br />the date of its final passage be suspended, and these provisions
