<br />~ tj71t <br /> Page 2 <br /> Letter Agreement <br /> Dave Burton Auctions <br /> May 25, 1993 <br /> (f) process each buyer at the time of check-out; <br /> (g) collect proceeds from the sale of property owned or <br /> held by the City, provide the City with an <br /> itemization of the gross proceeds of the sale, and <br />. - within ten days of the sale, provide the City with <br /> a check for the gross proceeds, less: <br /> Advertising: not to exceed $200.00 <br /> All other services: 14.4% of City's gross proceeds <br /> (h) indemnify, defend and save harmless the City and <br /> all its officers, agents and employees from all <br /> suits, actions, or other claims of any character, <br /> name and description brought for or on account of <br /> any injuries or damages received or sustained by <br /> any person, persons, or property on account of any <br /> negligent act or fault of the Auctioneer, or of any <br /> agent, employee, subcontractor or supplier in the <br /> execution of, or performance under this contract, <br /> the Auctioneer shall pay any judgment with cost <br /> which may be obtained against the City growing out <br /> of such injury or damages; <br /> (i) comply with all federal, state and local laws <br /> governing or covering this type of service; and <br /> ( j) provide equipment and supplies for the auction, <br /> including: <br /> ( 1) sign-in sheets <br /> (2) statement of purcha~es <br />- (3) individual clerking tickets <br /> (4) three public address systems <br /> (5) anything else deemed necessary by Auctioneer <br /> 2. Under the terms of this agreement the City shall: <br /> (a) provide two city employees to assist the Auctioneer <br /> with checking out buyers; <br /> (b) transport all of the City's auction items to the <br /> Civic Center and unload; and <br />
