<br /> (; '-( I/: <br /> WHEREAS, subsequent to that public hearing, the <br /> Commission considered the amendments and voted to approve the <br /> amendments and has recommended that the amendments be <br /> approved by the City Council; and, <br /> WHEREAS, the City Council hereby finds and determines <br /> that the adoption of the following amendments is in the <br /> interest of the public health, morals, welfare, and safety; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY.OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 2 (A) (2) of Appendix A, General <br /> Zoning Ordinance, of the San Marcos Code of Ordinances is <br /> amended with regard to the procedure for applying for a <br /> zoning map amendment to read as follows: <br /> (2) Applications for a zoning change shall be made <br /> on forms provided by the City. The staff shall <br /> review all zoning requests, and provide the <br /> Zoning Commission with their concerns and <br /> comments, and make sure that the Commission has <br /> sufficient information to make a recommendation. <br /> SECTION 2. That Section 2 of Appendix A, General Zoning <br /> Ordinance, of the San Marcos Code of Ordinances is amended to <br /> reletter existing subsection (E) and (F) as subsections (F) <br /> and (G), respectively, and to insert a new subsection (E) <br /> with regard to the consideration of a previously denied <br /> zoning map amendment to read as follows: <br /> (E) Consideration of previously denied zoning map <br /> amendments: A request to change the zonlng <br /> designation for any parcel of property shall not <br /> be considered by the Zoning Commission of the <br /> same requested change for all or any portion of <br /> the parcel of property unless the Zoning <br /> Commission determines that there has been a <br /> substantial change in conditions surrounding the <br /> parcel since the initial request and agrees to <br /> reconsider the change by a three-fourths vote of <br /> the members present and voting. <br /> SECTION 3. That Definition (14) for Building, in <br /> Section 4 of Appendix A, General Zoning Ordinance of the San <br /> Marcos Code of Ordinances is amended to read as follows: <br /> (14) Building: Any structure having a roof supported <br /> by columns or walls and intended for the shelter <br /> and/or enclosure of persons! animals, equipment, <br /> goods, or materials of any kind. <br /> SECTION 4. That Definition (56) for Lot, in Section 4 <br /> of Appendix A, General Zoning Ordinance of the San Marcos <br /> Code of Ordinances is amended by the addition of subparagraph <br /> (h) regarding minimum area requirements to read as follows: <br /> (h) Lot, Minimum Area: The total area measured <br /> within the boundaries of a lot which must exist <br /> to conform to the requirements of the zoning <br /> ..:J1_~__1_~ __1~1...1- __1...1_1... -'~ - - , ---~_..:J <br />
