65_ {V ry ORDINANCE 1993- 51 WHEREAS, the City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two (2) public hearings, held once on April 26, 1993 , and once on May 3, 1993 1 to consider the proposed annexation by the City of San Marcos, Texas of 23.41 acres, more or less, of land owned by Mr. Al Lowman fronting on the northwest right-of-way line of Interstate Highway 35 at its intersection with Center Point Road, Hays County, Texas, described by metes and bounds in attached Exhibit A; and, WHEREAS, an on-site public hearing has not been requested in writing by more than 20 adults residing in this area; and, WHEREAS, notices of these public hearings were published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the territory proposed for annexation, on April 11, 1993 , and April 18, 1993 , these dates being not more than twenty (20) days nor less than ten (10) days prior to the hearings for which notices were given; and, WHEREAS, prior to the publication of notices of these hearings, the City Council of the City of San Marcos, Texas directed preparation of a service plan that provides for the extension of municipal services to the area proposed for annexation; and, WHEREAS, the proposed service plan was made available for inspection and explained to the inhabitants of the area to be annexed at the public hearings; and, WHEREAS, this 23.41 acre tract is contiguous and adjacent to the current boundaries of the City of San Marcos, Texas; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the 23.41 acre tract of property described in Exhibit A which is attached hereto and incorporated herein for all purposes, adjoining the existing city limits of the City of San Marcos, Texas, fronting on the northwest right-of-way line of Interstate Highway 35 at its intersection with Center Point Road, Hays County, Texas, is hereby annexed to the City of San Marcos, Texas. SECTION 2. That the Service Plan for this area, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, is hereby approved. SECTION 3. That the corporate limits of the City are hereby extended to include this described territory. SECTION 4. That this described territory shall henceforth be a part of the City of San Marcos, Texas, and any residents thereof shall be entitled to all the rights and privileges of all citizens of the City, and shall be bound by the acts, ordinances, resolutions and regulations of the City.
