6.04 Parkland Dedication <br />Parkland dedication and /or payment of any fee in lieu of dedication is required in <br />accordance with the requirements of the City of San Marcos LDC. <br />Parkland dedication is calculated in accordance with Section 7.6.1.2 as follows: <br />5 acres (multiplied by) 306 units (multiplied by) 2.1 residents per unit (divided by) 1,000 <br />which equates to 3.21 acres of required parkland dedication. <br />The area of land commonly known as Thompson's Island which contains approximately <br />10 acres of land shall be dedicated as public parkland. In addition, all of the area <br />located within the floodway as well as the area contained within the Water Quality Zone <br />as indicated on the Watershed Protection Plan shall be dedicated as public parkland. <br />The total combined area of proposed parkland dedication is approximately 20 acres. <br />In addition to the above indicated parkland land dedication, the Project Site owner shall <br />provide for the following parkland development improvements: <br />1. Construction of a pedestrian trail located within the 100 foot Water Quality <br />Zone from the property boundary adjacent to IH -35 east to Cape Road. <br />2. Payment of a parkland development fee of a maximum of $75,000 as <br />contribution for the construction of off -site parking facilities. <br />3. Dedication of up to 35 feet of ROW along Cape Road, as necessary, to <br />provide for adequate space for on- street parking. <br />4. Construction of 12 spaces of on- street parking located on Cape Road <br />adjacent to the project site. <br />5. Striping of a pedestrian crossing across Cape Road to provide a connection <br />from Stokes Park to the above referenced trail. <br />6. Installation of a security gate and bollards at trail end on Cape Road to <br />provide for emergency access to dedicated parkland area. <br />All park improvements shall be engineered and constructed or fiscal surety posted to <br />pay for the improvements prior to the recordation of the final plat. <br />The construction of the parking facilities as indicated above shall be the responsibility of <br />the City. <br />The Project Site shall provide a minimum 24 foot access easement east from I H -35 <br />along the property boundary and then south along the property line to the proposed trail <br />in the Water Quality Zone to allow connectivity to IH -35. <br />Property owner shall grant City, by separate recordable instrument, an irrevocable right <br />of first refusal to purchase a tract of land of approximately 31.25 acres located south of <br />the San Marcos River and south of the Property in a form approved by the City Attorney <br />and valid for a period of one year from the effective date of this ordinance. <br />6.05 Environmental, Water Quality & Detention Standards <br />On -site water quality measures to control and treat stormwater runoff will be required <br />with the development of this site in accordance with the City of San Marcos LDC as well <br />as enhancements described herein. Development of the Project will adhere to a <br />standard for removal of a minimum of 85% of the increase in total suspended solids <br />0 <br />
