<br /> .' .. 7'),4 <br /> 0.1 STANDARDS OF PERFORMANCE <br /> 0.1.1 In the performance of all services in connection with this Agreement, <br /> the Consultant shall use that degree of care and skill ordinarily exercised for <br /> similar projects by Consu ltants who possess special expertise in the type of <br /> work involved in this project. Consultant shall be a representative but not an <br /> agent of the Owner. <br /> 0.1.2 The Owner recognizes that environmental, geologic and geotechnical <br /> conditions can vary from those encountered at the times and locations where <br /> data are obtained by the Consultant. Because the available data may be limited, <br /> the Owner recognizes that there is some level of uncertainty with respect to <br /> the interpretation of these environmental, geologic and geotechnical <br /> conditions, despite Consultant's use of due professional care and skill. <br /> 1.1 WORK PLAN <br /> ~ <br /> 1.1.1 The Consu ltant' s proposed Scope of Work is attached hereto as <br /> Attachment A, made a part hereof, and incorporated herein for all purposes, and <br /> the Consultant sha 11 have such other duties and responsibi 1 ities and <br /> limitations of authority as set forth therein. However, in the event of <br /> confl i ct, dispute or discrepancy between the provisions of this Agreement and <br /> the Consu ltant' s proposa 1, the more restrictive and/or burdensome provisions <br /> regarding the Consultant's performance shall govern and control. <br /> 1.1.2 Implementation of the Work Plan, including construction, sampling and <br /> analysis as proposed in the Work Plan that may subsequently be required by the <br /> Owner wi 11 be considered Additional Services and compensation made in <br /> accordance with Section 10.2, or, at the Owner's option, will be renegotiated <br /> under separate agreement or otherwise secured by the Owner. <br /> -2- <br />
