RDBNMS INSTALLATION ASSISTANCE <br /> NCC shall use its best efforts to provide the technical resources required to assist the Client in installing a <br /> new release of the Rdb database, at no additional cost to Client. This installation service may require that <br /> the customer load the newest release of the Licensed Software and may be timed to coincide with a new <br /> release of Application software as the installation of Rdb may necessitate changes to the Application <br /> software. NCC shall make the changes to the Application software on their release schedule. Upon <br /> notification from DEC of a new release, NCC will test the release at NCC, determine if the benefits of the <br /> new release are significant to improving overall Licensed Software performance to warrant inclusion with <br /> the next release of the Licensed Software, determine if Licensed Software changes are necessary and the <br /> associated effort, and notify the Client of the release schedule. Client will then schedule the installation <br /> using NCC's RFW process. <br /> NCC shall provide the technical resources required to assist the Client in installing a new release of the VMS <br /> Operating System, at no additional cost to Client provided the customer has a valid VMS maintenance <br /> Agreement in effect to receive the software. This installation service may require that the customer load <br /> the newest release of the Licensed Software and may be timed to coincide with a new release of the <br /> Application software as the installation of VMS may necessitate changes to the Application software. NCC <br /> shall make the changes to the Application software on their release schedule. Upon notification from DEC <br /> of a new release, NCC will test the release at NCC, determine the benefits of the new release for improving <br /> overall Licensed Software performance, determine if Licensed Software changes are necessary and the <br /> associated effort, and notify the Client of the release schedule. Client will then schedule the installation <br /> using NCC/s RFW process. <br /> . <br /> Any services to provide technical assistance in loading non NCC software is contingent upon the necessary <br /> changes being made to the Licensed Software to make it operate under the new environment. NCC may <br /> elect, at its sole discretion, not to modify its Licensed Software if NCC believes the benefits of the new non <br /> NCC software release are not substantial to improving the Licensed Software performance, or if the third <br /> party has announced another release to be delivered in a short time period. Any changes will be made as <br /> part of NCe's release schedule. <br /> 8. RELEASE INSTALLATION <br /> NCC will provide, at no additional cost, the services necessary to assist the Client in installing the new <br /> release of the Licensed Software on their system. NCC will notify Client of upcoming release dates and <br /> shipping dates, and Client will call NCC Customer Service and submit an RFW to schedule a date for <br /> installation. The new release will be loaded into a test environment and upon successful testing and written <br /> notification of such by Client, will be moved into a production environment. NCC takes no responsibility <br /> if new releases are not first loaded into a test environment and tested appropriately by Client. <br /> 9. CONVERSION <br /> NCC will provide any necessary standard conversion programs necessary to allow the customer to upgrade <br /> from the current release to the next release of the Licensed Software. The new release will corne with <br /> instructions for installation and the running of any conversion programs. NCC will, as part of the <br /> installation process and at no additional cost, assist the Client in running the conversion program. Client <br /> will have ultimate responsibility for the testing and integrity of the data. Client shall have sufficient disk <br /> space to conduct this activity in a test environment. NCe takes no responsibility if any installation or <br /> conversion is first done in a production environment. <br /> 19 <br />
