<br />I <br /> <br />RESOLUTION NO. 2007 126 -R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE PURCHASE OF TWO <br />PARCELS OF LAND TOTALING 0.907 ACRES, MORE OR LESS, FOR <br />A UTILITY EASEMENT IN CONNECTION WITH THE MCCARTY ROAD <br />16 INCH WATER MAIN PROJECT; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS IN <br />CONNECTION WITH THIS PURCHASE; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City of San Marcos is going to construct a water transmission main to be <br />known as the McCarty Road 16 Inch Watermain Project (the "Project"). The Project is <br />being constructed to deliver water to present and future customers. <br /> <br />2. The Project requires the City to obtain utility easements, rights-of-way or <br />other interests in certain real property in the vicinity of the Project. <br /> <br />3. The City has reached an agreement to purchase 0.907 acres of land, in <br />two parcels, belonging to the same party, at a total cost of $ 37,000.00. <br /> <br />I BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The purchase of an easement, as more fully described on the easement <br />attached to this Resolution as Exhibit 1, is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute all necessary <br />documents in connection with the purchase of the above described easements on <br />behalf of the City. <br /> <br />PART 3.
