REVOLVING LOAN FUND <br />PROGRAM REQUIREMENTS <br />The primary requirements for the RLF program are presented here in alphabetical order. The business <br />should become familiar with the requirements (as they pertain to the proposed project). <br />Accessibility Assistance: The City of San Marcos does not discriminate on the basis of disability in the <br />admission or access to its services, programs, or activities. Individuals who require auxiliary aids and services <br />should contact the City of San Marcos ADA Coordinator at 512 - 805 -2630 or 393 -8229 (TDD). <br />Requests can also be sent by e-mail to cityhall __sanmarcostx.gov. The Municipal Building is ADA accessible <br />and designated handicapped parking is available in the parking lot. Individuals with limited English proficiency <br />may request assistance by contacting the City at 393 -8147. (Las personas con habilidad limitada del Ingles <br />puede solicitar la asistencia poniendose en contacto con la Ciudad en 393 -8147. <br />Amortization Requirements- The following terms are generally offered by the Revolving Loan Fund: <br />(1) machinery and equipment financing 3 to 5 years or based on the useful remaining life of <br />the asset; <br />(2) working capital financing will be negotiated at the time of the award. <br />Application Submittal Applications should be submitted to the office of Development Services, located on the <br />second floor of the Municipal Building, 630 East Hopkins, San Marcos Texas 78666. The form of the <br />application submittal shall be in conformance with the Application Checklist. <br />Assurances — The applicant hereby assures and certifies, by the submission of an application, that it will <br />comply with the regulations, policies, guidelines and requirements, including Office of Management and Budget <br />Circulars Nos. A -87 and A -102, as they relate to the application, acceptance and use of federal funds for this <br />federally assisted project. . <br />Bankruptcy Filings- The City will not consider any application for funding in which the business to be <br />assisted there under or its principals have filed under the Federal Bankruptcy Code, and the matter is in <br />the process of being adjudicated or in which such business has been adjudicated bankrupt. <br />Business — All RLF applications must support proposed activities of a business. The benefiting business is one <br />that is proposing to create and /or retain jobs in the City of San Marcos. This may be a for - profit or a non - profit <br />business. Non - profit businesses must have language in their corporate articles and /or by -laws that specifically <br />authorizes them to engage in economic development activities. Governmental entities /units are not eligible and <br />do not qualify as the benefiting business. <br />Citizen Participation The City of San Marcos follows a detailed citizen participation plan that provides for and <br />encourages citizen participation at all stages of the community development program. The Citizens Participation <br />Plan is included and may be reviewed in the current CDBG Program Consolidated Plan. Copies may also be <br />obtained from the Development Services — Planning office. <br />Collateral -The City prefers to be fully - collateralized; however, where the City is not the major lender in <br />the project a subordinate lien position will be considered, with regard to the Revolving Loan Fund. <br />Conflict of Interest — Under the federal conflict of interest provisions at 24 CFR 570.489(h) that are included in <br />the regulations governing state administration of Community Development Block Grant funds (24 CFR 470, <br />Subpart 1), no persons who exercise or have exercised any function or responsibilities with respect to CDBG <br />activities, or who are in a position to participate in a decision making process, or gain inside information <br />regarding CDBG activities may obtain a financial interest or benefit from the activity, or have interest in any <br />contract, subcontract, or agreement, or the proceeds thereunder, either for themselves or those with whom they <br />5 <br />
