<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING LOT 38 OF
<br />BLOCK A, PARKLANE GARDEN HOMES SUBDIVISION,
<br />PHASE II, AS RECORDED IN VOLUME 5, PAGE 165 OF
<br />THE HAYS COUNTY PLAT RECORDS AND LOT 59 OF
<br />BLOCK A AND LOT 33 OF BLOCK B OF SUNRIDGE
<br />P. U. D. SUBDIVISION AS RECORDED IN VOLUME 4,
<br />PAGES 309-311 OF THE HAYS COUNTY PLAT RECORDS,
<br />FROM "PUD" PLANNED UNIT DEVELOPMENT DISTRICT
<br />TO "P" PUBLIC AND INSTITUTIONAL DISTRICT AND
<br />DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on May 25,1993, the zoning commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "PUD" Planned unit Development District to "P" Public
<br />and Institutional District for Lot 38 of Block A, Park lane Garden
<br />Homes Subdivision, Phase II, as recorded in Volume 5, Page 165 of
<br />the Hays County Plat Records and Lot 59 of Block A and Lot 33 of
<br />Block B of Sunridge P.U.D. Subdivision as recorded in Volume 4,
<br />Pages 309-311 of the Hays County Plat Records, and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on May 25, 1993 consider the request and voted to
<br />approve it and has recommended that the request be approved by the
<br />city Council of the City; and¡
<br />
<br />WHEREAS, the city Council held a public hearing on the 12th
<br />day of July, 19931 regarding the request; and¡
<br />and August 9, 1993,
<br />WHEREAS, all requirements, of Appendix A, General zoning
<br />Ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the city Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Off icial zoning Map of the city, as
<br />described in section 3 of the General Zoning Ordinance, is hereby
<br />amended to rezone the following described real property located in
<br />San Marcos, Hays County, Texas, which is presently zoned "PUD"
<br />Planned unit Development District to IIp'' Public and Institutional
<br />District:

<br />LOT 38 OF BLOCK A, PARKLANE GARDEN HOMES SUBDIVISION,
<br />PHASE II, AS RECORDED IN VOLUME 5, PAGE 165, OF THE HAYS
<br />COUNTY PLAT RECORDS AND LOT 59 OF BLOCK A AND LOTS 33 OF
<br />BLOCK B, OF SUNRIDGE P.U.D. SUBDIVISION AS RECORDED IN
<br />VOLUME 4, PAGES 309-311 OF THE HAYS COUNTY PLAT RECORDS.

<br />SECTION 2. That this Ordinance shall be in effect ten (10)
<br />days from and after its passage and after it has been subject to
<br />reco~sideration by the Council at its next regular meeting
<br />following its passage, and provided that the Council did not vote
<br />to reconsider it. If reconsidered on August 23, 1993 it shall be
<br />in effect ten days from and after its passage on that date if
<br />approved. It shall not go into effect if denied. If not
<br />reconsidered and approved it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the
<br />
