<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br /> ZONING MAP OF THE CITY BY REZONING 3.69 ACRES
<br /> OF LAND, MORE OR LESS, OUT OF THE J.M.
<br /> VERAMENDI LEAGUE NO. 2, ABSTRACT NO. 17 IN
<br /> HAYS COUNTY, TEXAS, LOCATED ON THE SOUTHEAST
<br />, SIDE OF THE 600 BLOCK OF CHEATHAM STREET FROM
<br /> "c" COMMERCIAL DISTRICT TO liP" PUBLIC AND
<br /> INSTITUTIONAL DISTRICT AND DECLARING AN
<br /> EFFECTIVE DATE.
<br /> WHEREAS, on September 1, 1992, the Zoning commission of the
<br /> city of San Marcos held a public hearing regarding a request to
<br /> change the zoning from "C" commercial District to "P" Public ar.d
<br /> Institutional District for 3.69 acres of land, more or less, out of
<br /> the J .M. Veramendi League No. 2, Abstract No. 17 in Hays County,
<br /> Texas located on the southeast side of the 600 block of Cheatham
<br /> Street; and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br /> Commission did, on September 1, 1992 consider the request and voted
<br /> to approve it and has recommended that the requesb be approved by
<br /> the City Council of the City; and,
<br /> WHEREAS, the city Council held a public hearing on the 13th
<br /> day of September , 1993, regarding the request¡ and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the city of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the
<br /> public health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the Official zoning Map of the city, as
<br /> described in section 3 of the General Zoning Ordinance, is hereby
<br /> amended to rezone the following described real property located on
<br /> the southeast side of the 600 block of Cheatham Street, San Marcos,
<br /> Hays County, Texas, which is presently zoned IIC" Commercial
<br /> District to "P" Public and Institutional District:
<br /> 3.69 acres of land, more or less, out of the J.M.
<br /> Veramendi League No. 2, Abstract No. 17 in Hays County,
<br /> Texas, consisting of the 4.0 acre tract of land described
<br /> by metes and bounds in the attached Exhibit "A", SAVE AND
<br /> EXCEPT the 9,000 square foot and 4,477 square foot tracts.
<br /> of land being more particularly described by metes and
<br /> bounds in the attached Exhibit liB" and "C", respectively.
<br /> SECTION 2. That this Ordinance shall be in effect ten (10)
<br /> days from and after its passage and after it has been subject to
<br /> reconsideration by the Council at its next regular meeting
<br /> following its passage, and provided that the Council did not vote
<br /> to reconsider it. If reconsidered on September 27, 19~:t: shall be
<br /> in effect ten days from and after its passage on that date if
<br /> approved. It shall not go into effect if denied. If not
<br /> reconsidered and approved it shall be published in a newspaper of
<br /> general circulation in the area as required by the Charter of the
<br /> city of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this 13th day of Septembe~ 1993,
<br /> subject to reconsideration at the next regular City Council meeting
<br /> scheduled for September 27, 1993.
