<br /> S-2B <br /> -3- <br /> for the maintenance thereof shall become the duty of the city. No <br /> street, alley, highway, or public place shall be encumbered by <br /> Bluebonnet for a longer period than necessary to execute the work. <br /> SECTION 5. Public Safety and Convenience. All appurtenances <br /> <br /> and appliances used or useful in enabling Bluebonnet to maintain <br /> its electric utility services shall be placed and maintained with <br /> due consideration for the public safety and convenience, and any <br /> hazards created by storms, accidents, or other causes will be <br /> remove without undue delay. <br /> SECTION 6. Outside Plant Accommodations. Bluebonnet, on <br /> <br /> request of any person, may remove or raise or lower its wires <br /> temporarily to permit the moving of houses or other bulky <br /> , <br /> structures. The expense of such temporary removal, raising or <br /> lowering of wires or other appurtenances for the benefit of private <br /> parties shall be paid by the benefited party or parties, and <br /> Bluebonnet may require such payment in advance. Bluebonnet may <br /> require not less than seventy-two (72) hours advance notice to <br /> arrange for such temporary changes., <br /> SECTION 7. Tree Trimminq. Bluebonnet shall have the right, <br /> license, privilege and permission to trim trees and bushes upon and <br /> overhanging the streets, alleys, sidewalks, rights-of-way and <br /> public places of the city, so as to prevent the branches thereof <br /> from coming in contact with the wires or cables of Bluebonnet and, <br /> when so requested by the City, said trimming shall be done under <br /> the supervision and direction of the city Manager or the <br /> appropriate city official to whom such duties have been delegated. <br /> SECTION 8. Indemnification. Bluebonnet agrees to indemnify, <br /> hold harmless and defend the city and its officials or employees <br /> from and against any claims or liability which may be incurred by <br /> reason of any act or omission of Bluebonnet in connection with its <br /> operations hereunder. <br /> SECTION 9. Cash Consideration. From and after the effective <br /> of this ordinance Bluebonnet shall pay to the city for its <br /> supervision of this Agreement, for annual inspection fees, for <br /> service charges, and for the use of its streets, alleys, sidewalks, <br />
