Iò--,'-::;' .J ~~ "'" ~ :0:-.1 '.:':: :=D ORDIN~~CE 1993- 73 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING ON OCTOBER 1, 1993 AND ENDING ON SEPTEMBER 30, 1994, REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AUTHORIZING TRANSFERS OF FUNDS WITHIN DEPARTMENTS WITH THE APPROVAL OF THE CITY MANAGER, AND DECLARING AN EMERGENCY. WHEREAS, the Charter of the City of San Marcos, Texas provides that the city Council shall set a time and place of public hearing on the proposed budget for the city and shall cause notice of the hearing and a summary of the budget to be published in one or more newspapers of general circulation in the city; and, WHEREAS, the city Council at its regular meeting on July 26, 1993 ,set the date of this hearing and directed the notice and budget summary be published; and, WHEREAS, the notice and budget summary were published in at least one newspaper of general circulation in the city on . July 29,1993 ,a date at least ten (10) days pFior to the date set for the public hearing on the budget for the city for the fiscal year beginning October 1, 1993 and ending September 30, 1994; and, WHEREAS, the public hearing on the budget was held on ;";.ugust 9, 1993 ,a time at which all interested persons were given an opportunity to be heard for or against any item or the amount of any item contained in the budget; and, WHEREAS, at least fourteen (14) days have elapsed since the public hearing on the budget as required by the City Charter; and, now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the City of San Marcos operating and Capital Budget, Fiscal Year 1993-94, as shown in words and figures therein is hereby approved and adopted for the fiscal year beginning October 1, 1993 and ending September 30, 1994. SECTION 2. That there is hereby appropriated the amount shown in the city of San Marcos operating and Capital Budget, Fiscal Year 1993-94 necessary to provide for a sinking fund for the payment of the principal and interest and the retirement of the bonded debt of the city. SECTION 3. That fund transfers among the accounts wi thin each department, and reclassification of positions within each department, may be made with the approval of the city Manager. SECTION 4. That should any part, portion, or section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, or sections or parts of a section of this ordinance, which provisions shall be, remain and continue to be in full force and effect. SECTION 5. That all ordinances and appropriations for which provision has heretofore been made are hereby expressly repealed if in conflict with the provisions of this ordinance. SECTION 6. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall. be presented at three separate meetings and that no ordinance shall become
