<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING LOT 29,
<br />BLOCK 2 OF THE WESTOVER ADDITION TO THE CITY
<br />OF SAN MARCOS AS RECORDED IN VOLUME 59, PAGE
<br />184 OF THE HAYS COUNTY DEED RECORDS, LOCATED
<br />AT 1400 CLYDE STREET FROM "M" SINGLE-FAMILY,
<br />DUPLEX, AND NEIGHBORHOOD BUSINESS DISTRICT TO
<br />"DP-2" TWO-FAMILY DWELLING DISTRICT (MEDIUM
<br />DENSITY) AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 29, 1993, the zoning commission of the city
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" single-Family, Duplex, and Neighborhood
<br />Business District to "DP-2" Two-Family Dwelling District (medium
<br />density) for Lot 29, Block 2 of the Westover Addition to the city
<br />of San Marcos, Texas, located at 1400 Clyde street; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on June 29, 1993 consider the request and voted to
<br />approve it and has recommended that the request be approved by the
<br />city Council of the city; and, ~

<br />WHEREAS, the city Council held a public hearing on the 27th
<br />day of September, 1993, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and $afety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Official zoning Map of the City, as
<br />described in section 3 of the General zoning Ordinance, is hereby
<br />amended to rezone the following described real property located at
<br />1400 Clyde Street, San Marcos, Hays County, Texas, which is
<br />presently zoned "M" Single-Family, Duplex, and Neighborhood
<br />Business District to "DP-2" Two-Family Dwelling District (Medium
<br />Density) :

<br />LOT 29, BLOCK 2 OF THE WESTOVER ADDITION TO THE CITY OF
<br />SAN MARCOS AS RECORDED IN VOLUME 59, PAGE 184 OF THE HAYS
<br />COUNTY DEED RECORDS.

<br />SECTION 2. That this Ordinance shall be in effect ten (10)
<br />days from and after its passage and after it has been subject to
<br />reconsideration by the council at its next regular meeting
<br />following its passage, and provided that the Council did not vote
<br />to reconsider it. If reconsidered on October II, 1993 it shall be
<br />¡ in effect ten days from and a~ter its pass~ge on. that date if
<br />, approved. It shall not go J.nto effect J.f denJ.ed. If not
<br />reconsidered and approved it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the
<br />city of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 27th day of September, 1993,
<br />subject to reconsideration at the next regular city Council meeting
<br />scheduled for October II, 19 9 3 . .
