Guadalupe <br /> San Marcos, TX 78666 <br /> Re: Estates of San Marcos Subdivision <br /> Dear Mr. Barker: <br /> This letter, upon countersignature below, will serve as an <br /> amendment to the agreement for the city's acquisition of the water <br /> system serving the Estates of San Marcos Subdivision (the <br /> "Subdivision"). <br /> As a substitute for Item 1 in the agreement, the Sellers have <br /> dedicated to the public, and Hays County has accepted maintenance <br /> responsibility for, all roads within the Subdivision. The Sellers <br /> agree to complete the paving of the cul-de-sacs within the <br /> Subdivision no later than November 1, 1993. Items 2 and 8 in the <br /> agreement will occur simultaneously as soon as possible after the <br /> cul-de-sac paving is completed, and the obligation in item 6 in the <br /> agreement will take effect upon the ,completion of items 2 and 8. <br /> The real property interests to be conveyed to the City under item <br /> 2 include the well site shown as an easement on the plat of the <br /> Subdivision, the well and equipment site adjacent to the <br /> Subdivision owned in fee simple by the Sellers, and ~n access and <br /> public utility easement between the cul-de-sac at the most <br /> northerly end of Mountain High Drive and the well and equipment <br /> site referred to above. <br /> The City's undertaking of responsibility for operation of the water <br /> system, and the City's entitlement to all revenues of the system, <br /> will also begin upon the completion of items 2 and 8. <br /> 630 East Hopkins.
