<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING A PORTION
<br />OF LOTS 11 AND 12, BLOCK 12, FIRST SECTION,
<br />VICTORY GARDENS ADDITION TO THE CITY OF SAN,
<br />MARCOS, AS RECORDED IN VOLUME 128, PAGE 46 OF
<br />THE HAYS COUNTY DEED RECORDS, LOCATED AT 405
<br />ARMSTRONG STREET FROM "M" SINGLE-FAMILY,
<br />DUPLEX, AND NEIGHBORHOOD BUSINESS DISTRICT TO
<br />"R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW
<br />DENSITY) AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 29, 1993, the Zoning Commission of the city
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "M" Single-Family, Duplex, and Neighborhood
<br />Business District to "R-1" Single-Family Dwelling District (low
<br />density) for a portion of Lots 11 and 12, Block 12, First section,
<br />Victory Gardens Addition to the city of San Marcos, Hays County,
<br />Texas, located at 405 Armstrong Street; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on June 29, 1993 consider the request and voted to
<br />approve it and has recommended that the request be approved by the
<br />city Council of the city; and,
<br />
<br />WHEREAS, the city Council held a public hearing on the 11th
<br />day of October , 1993, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the city Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the city, as
<br />described in Section 3 of the General Zoning Ordinance, is hereby
<br />amended to rezone the portion of the following described real
<br />property located at 405 Armstrong street, San Marcos, Hays County,
<br />Texas, which is presently zoned "M" single-Family, Duplex, and
<br />Neighborhood Business District to "R-1" Single-Family Dwelling
<br />District (low density) :
<br />
<br />LOTS 11 AND 12, BLOCK 12, FIRST SECTION, VICTORY GARDENS
<br />ADDITION TO THE CITY OF SAN MARCOS, AS RECORDED IN VOLUME
<br />128, PAGE 46 OF THE HAYS COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10)
<br />days from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting
<br />following its passage, and provided that the Council did not vote
<br />to reconsider it. If reconsidered on October 25, 1993 it shall be
<br />in effect ten days from and after its passage on that date if
<br />approved. It shall not go into effect if denied. If not
<br />reconsidered and approved it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the
<br />city of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 11th day of October, 1993,
<br />subject to reconsideration at the next regular city Council meeting
<br />scheduled for October 25, 1993
