RESOLUTION NO. R 2013 -38R <br />A RESOLUTION BY THE CITY OF SAN MARCOS, TEXAS, <br />RECOMMENDING TO THE TEXAS DEPARTMENT OF <br />TRANSPORTATION THAT CAPITAL AREA RURAL <br />TRANSPORTATION SYSTEM ("CARTS") BE CHOSEN AS THE DIRECT <br />RECIPIENT FOR FEDERAL FUNDS IN ACCORDANCE WITH TITLE 49, <br />SUBTITLE III, CHAPTER 53, SECTION 5307 OF THE UNITED STATES <br />CODE, FOR THE SAN MARCOS URBANIZED AREA; AUTHORIZING <br />THE MAYOR TO EXECUTE ANY DOCUMENTS REQUIRED TO <br />EVIDENCE THE CITY'S SUPPORT OF CARTS AS THE DIRECT <br />RECIPIENT FOR FEDERAL SECTION 5307 FUNDING; AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br />RECITALS: <br />1. The 2010 U.S. Census changes in urbanized area boundaries has designated the San <br />Marcos area as a new urbanized area, including a population greater than 50,000, but less than <br />200,000; and <br />2. The boundaries of the new urbanized area include the City of San Marcos, the City of <br />Martindale, and unincorporated portions of Hays, Guadalupe and Caldwell Counties; and <br />3. On August 21, 2012, pursuant to the provisions of CHAPTER 458 OF THE TEXAS <br />TRANSPORTATION CODE, this City Council supported creation of an urban -rural transit <br />district by the Capital Area Rural Transportation System (CARTS) in order to receive state <br />public transit funding; and <br />4. The Capital Area Rural Transportation System (CARTS) has created an urban -rural <br />transit district, including the San Marcos urbanized area; and <br />5. Federal transportation statutes include a formula funding program in support of public <br />transportation services in urbanized areas, known as the Section 5307 program; and <br />6. The Governor of the State of Texas has delegated to the Texas Department of <br />Transportation authority including that of being the Designated Recipient for the Section 5307 <br />program, for urbanized areas with a population greater than or equal to 50,000, but less than <br />200,000; and <br />7. Implementation of the Section 5307 program requires selection of a Direct Recipient in <br />each such urbanized area, based upon a local process that results in a recommendation of a <br />Direct Recipient to the Texas Department of Transportation. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />1 <br />
