<br />r;;.r) 6 <br /> <br />state and federal governments including but not limited to those <br /> <br />laws, <br /> <br />ordinances, <br /> <br />codes <br /> <br />and regulations pertaining to equal <br /> <br />employment opportunity and those pertaining to discrimination <br /> <br />against participants. With respect to the requirement of State law <br />that a contract for human services to the indigent entered into <br /> <br />between a City and a social services organization may not provide <br /> <br />for more than 50% of the annual budget of the organization to be <br /> <br />derived from City funds, PHS declares that at the time of the <br /> <br />execution of this agreement, funds to be provided herein do not <br /> <br />exceed 50% of 'the annual budget of PHS. <br /> <br />In the event that such <br /> <br />funds do exceed 50% of the annual budget of PHS at any time during <br /> <br />which this contract is in effect, PHS agrees to notify City <br /> <br />immediately so that appropriate monetary adjustments to, this <br /> <br />~ <br /> <br />contract can be made to assure compliance with State Law. <br /> <br />SECTION 10. Breach of Contract: <br /> <br />A. If the City Manager of the City determines that the <br /> <br />activities as described in the Human Services funding application <br /> <br />attached hereto are not being carried out as approved by the City or <br /> <br />that PHS is in breach of any of the, terms of this agreement, the <br /> <br />City Manager shall notify PHS in writing of the deficiency. PHS <br /> <br />shall have ten (10) working days from the date of the notice to <br /> <br />correct or satisfy the deficiency. <br /> <br />B. If the deficiency is not appropriately corrected or <br /> <br />satisified in the opinion of the City Manager within the prescribed <br /> <br />time, notice may be given to PHS that its funding will be <br /> <br />terminated. <br /> <br />-3- <br />
