<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING 0.54 ACRES,
<br />MORE OR LESS, OF LAND AREA IN THE J.M.
<br />VERAMENDI LEAGUE NO. TWO, CITY OF SAN MARCOS,
<br />HAYS COUNTY, TEXAS, LOCATED AT 639 HOPKINS,
<br />STREET FROM "M" SINGLE-FAMILY, DUPLEX AND
<br />i NEIGHBORHOOD BUSINESS DISTRICT TO "c"
<br />~ COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />WHEREAS, on September 7, 1993, the Zoning commission of the
<br />City of San Marcos held a public hearing regarding a request to
<br />change the zoning from "M" Single-Family, Duplex and Neighborhood
<br />Business District to "C" Commercial District for 0.54 acres, more
<br />or less, of land area in the J.M. Veramendi League No. Two, San
<br />Marcos, Hays County, Texas, located at 639 Hopkins street; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on September 7,1993 consider the request and voted
<br />to approve it and has recommended that the request be approved by
<br />the city council of the City; and,
<br />.
<br />WHEREAS, the City Council held a public hearing on the 25th
<br />day of October, 1993, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the city Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the City, as
<br />described in section 3 of the General Zoning Ordinance, is hereby
<br />amended to rezone the following described real property in the J.M.
<br />Veramendi League No. Two, located at 639 Hopkins Street, San
<br />Marcos, Hays County, Texas, which is presently zoned "M" Single- '-~-
<br />family, Duplex, and Neighborhood Business District to "C"
<br />Commercial District:
<br />
<br />BEGINNING at a point in the North line of Bugg Lane at a
<br />point which bears South 45° 40' East 367.16 feet from the
<br />most Westerly corner of the 2.7 acre tract of land
<br />described in said deed from Charles K. Zunker, et ux, to
<br />Faustino Selvera, et ux¡
<br />
<br />THENCE South 45° 30' East 95.84 feet to a concrete marker
<br />at the most Western corner of a .145 acre tract conveyed
<br />by that deed from the said Selvera and wife to the State
<br />of Texas, dated August 11, 1964, and recorded in Volume
<br />202, Pages 355-356, Deed Records of Hays County, Texas;
<br />
<br />THENCE South 80° 31' East 94.4 feet to an iron stake for
<br />corner in the West right-of-way line of said railroad;
<br />
<br />THENCE in a Northerly direction and with said right-of-
<br />way line along a curve radius of 1411.69 feet a distance
<br />of 256.24 feet to an iron stake for the most Northerly
<br />corner of this tract in said right-of-way line;
<br />
<br />THENCE South 44° 30' West 242.75 feet to the PLACE OF
<br />BEGINNING; and being the identical land conveyed by that
<br />deed from the said Faustino Selvera and wife, to Emmett
<br />N. Hagedorn and Baldemar Selvera dated December 30,1969,
