INl'RODUCT ION - The Debtor in this case is The Brown Schools of San Marcos, Inc. ("Debtor"). The Brown Schools of San Ma rcos, Inc. filed its Petition under Chapter 11 of the Bankruptcy Code on July 20, 1992. Chapter 11 > is the business reorganization provision of the Bankruptcy Code. ~he Bankruptcy Code allows a Debtor to submit a Plan providing for the reorganization of its debts. The Debtor and HealthVest (collectively referred to as "Plan Proponents") file this Disclosure Statement for the Plan of Reorganization for The Brown Schools of San Marcos, Inc. (The San Marcos Treatment Center) (the "Plan'! or the "San Marcos Plan"). This Disclosure Statement has been prepared by HealthVest and the Debtor pursuant to § 1125 of the Bankruptcy Code, which requires that creditors receive a written disclosure statement containing sufficient information about the Debtor to enable creditors to make an informed and intelligent decision regarding the Ãmended Plan of Reorganiz~tion. Prior to the solid tation of your vote on the Plan, and as required by the Code, the Bankruptcy Court has approved this Disclosure Statement as containing adequate information.
