<br /> 20 <br /> INTERLOCAL AGREEMENT <br /> RELATED TO SCHOOL CONSTRUCTION --~ ~- <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> SECTION 1. PARTIES. This agreement is between the city of San <br /> Marcos, a Texas municipal corporation (the "city") and the San <br /> Marcos Consolidated Independent School District, a political <br /> subdivision of the State of Texas ("SMCISD"). <br /> SECTION 2. RECITALS. <br /> 2.1 SMCISD is in the process of developing an intermediate school <br /> (the "School") on a 26.36 acre tract of property (the "Property") <br /> at the intersection of Hunter Road and Stagecoach Drive in San <br /> Marcos, Texas. SMCISD and the other owners of the Property are in <br /> the process of obtaining the city's approval of a subdivision plat <br /> of the Property. <br /> 2.2 SMCISD has requested, and the City's Planning Commission has <br /> agreed to grant, a variance to the city ordinance which requires <br /> the final plat of a subdivision to be filed in cou~ty plat records <br /> before a building permit can be issued for construction within the <br /> subdivision. <br /> 2.3 The variance granted by the Planning Commission is expressly <br /> conditioned on SMCISD's execution and faithful performance of this <br /> agreement. <br /> SECTION 3. SMCISD OBLIGATIONS. <br /> 3.1 SMCISD, through a Texas registered professional engineer, <br /> agrees to complete the process for p~atting of the Property and to <br /> prepare and submit construction drawings, specifications and <br /> detailed engineering estimates for all road and utili ty <br /> improvements associated with the construction of the School and the <br /> platting of the Property (the "Improvements") to the city as soon <br /> as possible. <br /> 3.2 SMCISD agrees to apply for and obtain all building permits <br /> from the City required for construction of the School in full <br /> compliance with city building and fire safety codes. <br /> 3.3 SMCISD agrees to construct the Improvements to city standards. <br /> 3.4 SMCISD understands and agrees that the Improvements must be <br /> fully completed by SMCISD and accepted by the City before a <br /> Certificate of Occupancy will be issued by the City and before <br /> utility services to the School are instituted in the name of <br /> SMCISD. <br />
