Thence, N 540-30' West, along a line parallel to the Southwest street line of Railroad Street, a distance of 166.67' to a point in the Southeast street line of Purgatory Street, said point also marks the most Westerly corner of the herein described property. Thence, N 350-30' E, along the Southeast street line of Purgatory Street, a distance of 15.00', to the point of beginning is needed for public use by the City of San Marcos, Texas. SECTION 2. That said portion of land shall be used to re-construct and widen the portion of Railroad Street located in the City of San Marcos, Texas and between the Missouri~Pacific Railroad tracks and Purgatory Street. SECT10N 3. That the City through diligent effort has been un- able to determine the ownership of Lot One (1), Block Two (2) of the Dan McKie First Addition to the City of San Marcos and has, therefore, been unable to agree with the owner of said portion upon the value of the land or the damages. SECTION 4. That the city attorney of the city of San Marcos, Texas, Barbara Jean Edwards be, and she is hereby, authorized to institute condemnation proceedings in a court of proper jurisdic- tion for the purpose of acquiring a fifteen (15) foot by one hundred sixty seven (167) foot portion of land abutting Railroad Street in the City of San Marcos, Texas, said portion out of Lot One (1), Block Two (2) of the Dan McKie First Addition to the City of San Marcos, Texas. SECTION 5. That this Ordinance shall be in full force and effect ten (10) days from and after final passage and publication in a newspaper of general circulation.
