<br /> !D <br /> employed, and that employees are treated during employment, <br /> without regard to race, color, religion, sex, national origin, age <br /> or disability. Such action shall include, but not be limited to, <br /> the following: employment, upgrading, demotion, or transfer; <br /> recruitment or recruitment advertising; and, selection for <br /> training, including apprenticeship. DEBTOR agrees to post in <br /> conspicuous places available to employees and applicants for <br /> employment, notices setting forth the provisions of this <br /> non-discrimination clause. DEBTOR further agrees that all <br /> advertisements or solicitations for employees placed by or on <br /> behalf of DEBTOR will include the statement that all qualified <br /> applicants will receive consideration for employment without <br /> regard to race, color, religion, sex, national origin, age or <br />- ~~ disability. <br /> 4.7 DEBTOR shall comply with the provisions of the Civil <br /> Rights Act of 1964, as amended, which states that no person shall, <br /> on the grounds of race, color, or national origin, be excluded <br /> from participation in, be denied the benefits of, or be subjected <br /> to discrimination under any program or activity receiving federal <br /> financial assistance. <br /> 4.8 The Housing and Community Development Act of 1974 <br /> provides that: "No person in the United States shall, on the <br /> ground of race, color, national origin or sex be excluded from <br /> participation in, be denied the benefits of or be subjected to <br /> discrimination under any program or activity funded in whole or in <br /> part with funds made available under this title. Any prohibition <br /> against discrimination on the basis of age under the Age <br /> Discrimination Act of 1975 [ 42 USCS 1601 et seq.j or with respect <br /> to an otherwise qualified handicapped individual as provided in <br /> Section 504 of the Rehabilitation Act of 1973 [29 USCS 794] shall <br /> also apply to such program or activity." DEBTOR agrees to comply <br /> with the foregoing conditions and requirements. <br /> 4.9 DEBTOR guarantees that any building which is constructed <br /> or renovated for its use during the term of this Agreement and the <br /> repayment of the RLF loan, shall be constructed or renovated, <br /> whether with RLF funds or with private funds, in compliance with <br /> the Americans with Disabilities Act of 1990, which includes but is <br /> not limited to a specific requirement for handicap access. <br /> 4.10 In performing this Agreement, DEBTOR shall comply with <br /> all local, state and federal laws. <br /> 4.11 The guidelines of the City's RLF Program, the RLF <br /> Pre-Application form and, the RLF Formal Application form <br /> submitted by DEBTOR for assistance under the RLF are incorporated <br /> by reference hereto and shall be as binding upon the DEBTOR as if <br /> contained herein. <br /> 4.12 With the exception of the repayment of the RLF loan, and <br /> the maintenance of jobs, DEBTOR agrees that it will have complied <br />
