'l:) <; <br />'11:,. , _1?- b <br /> <br />--,~!:æ- ~5 ORDINANCE 1993- 89 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING 26.00 ACRES <br />OF LAND OUT OF THE EDWARD BURLESON SURVEY, NO. <br />18, A-63, HAYS COUNTY, TEXAS, LOCATED AT THE <br />WEST CORNER OF THE INTERSECTION OF IH-35 SOUTH, <br />AND CENTERPOINT ROAD FROM UNZONED, "PD" PRE- <br />DEVELOPMENT DISTRIGT AND "AR" AGRICULTURAL- <br />RANCH DISTRICT TO "c" COMMERCIAL DISTRICT AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on August 31,1993, the zoning Commission of the City <br />of San Marcos held a public hearing regarding a request to change <br />the zoning from "unzoned, "PD" Pre-development District and "AR" <br />Agricultural-Ranch District to "c" commercial District for 26.00 <br />acres of land out of the Edward Burleson Survey, No. 18, A-63, San <br />Marcos, Hays County, Texas, located at the west corner of the <br />intersection of IH-35 South and Centerpoint Road; and, <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />commission did, on August 31, 1993 consider the request and voted <br />to approve it and has recommended that the request be approved by <br />the city Council of the city; and, ~ <br /> <br />WHEREAS, the city council held a public hearing on the 13th <br />day of December, 1993, regarding the request; and, <br /> <br />WHEREAS, all requirements of Appendix A, General zoning <br />Ordinance, of the Code of Ordinances of the City of San Marcos <br />pertaining to amendments have been met; and, <br /> <br />WHEREAS, the city Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official zoning Map of the city, as <br />described in section 3 of the General zoning Ordinance, is hereby <br />amended to rezone the following described real property located at <br />the west corner of the intersection of IH-35 South and centerpoint <br />Road, San Marcos, Hays County, Texas, part of which is presently <br />unzoned and part of which is presently zoned "PDt! Pre-development <br />District, and "AR" Agricultural-Ranch District, to "C" commercial <br />District: <br /> <br />FIELD NOTE DESCRIPTION <br />OF A SURVEY <br />OF <br />26.00 ACRES OF LAND <br />OUT OF THE <br />EDWARD BURLESON SURVEY, NO. 18, 1-63 <br />HAYS COUNTY, TEXAS <br /> <br />BEING 26.00 ACRES OF LAND OUT OF THAT 955 ACRE TRACT OF <br />LAND CONVEYED TO LOWMAN RANCH, LTD. , A LIMITED <br />PARTNERSHIP BY GRACE B.
