Qã CITY OF SAN MARCOS, TEXAS, ABANDONING AND VACATING AN ALLEYWAY LOCATED IN BLOCK 13 OF THE WESTOVER ADDITION¡ AUTHORIZING THE CITY MANAGER TO EXECUTE QUITCLAIM DEEDS TO ABUTTING PROPERTY OWNERS¡ AND DECLARING AN EMERGENCY WHEREAS, the Westover Addition appears of record in the Deed Records of Hays County, Texas, in Book 59 at page 183¡ and, WHEREAS, the plat or map of this Addition shows an alley . located in Block 13 separating Lots 105 through 110 from Lots 111 through 116¡ and, WHEREAS, the City has been requested by Delfino and Anita Ramirez to abandon this alley; and, WHEREAS, the City has determined that it is in the public interest to abandon this alley and to convey the City's interest to the abutting property owners¡ now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the alleyway located in Blotk 13 of Westover Addition to the City of San Marcos, per the plat recorded in Volume 59, Page 183, Deed Records of Hays County, Texas, is vacated and abandoned as to any use, right, claim in, or responsibility for the upkeep and maintenance by the public in general and the City of San Marcos in particular. SECTION 2. That the City Manager is authorized to execute Quitclaim Deeds to the abutting property owners who own the fee simple interest underlying the alleyway, SECTION 3. That the conveyan~e to abutting property owners under this ordinance are determined to be in the public interest, and they will therefore be made without payment of consideration by the abutting property owners. SECTION 4. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that Ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation with the City as provided by the City Charter of the City of San Marcos.
