<br /> ADDENDUM NUMBER ONE <br /> TO THE ENERGY FITNESS PROGRAM AGREEMENT <br /> BETWEEN LCRA AND SMEU <br /> DATE: 2/11/92 <br /> <br /> FINANCING ARRANGEMENTS <br /> 1. - I elect to participate in LCRA's rebate program. <br /> I. Prowam Financin&" Plan. Through Wholesale Customer, LCRA shall provide financing for the <br /> purchase and installation of Improvements under the Program Financing Plan (hereinafter called <br /> "Financing Plan") in accordance with Wholesale Customer's selection of financing arrangements <br /> above and the following: <br /> A. Rebate Option <br /> <br /> (1) LŒ.A shall pay to Wholesale Customer rebates for installations of Improvements in <br /> furtherance of this Agreement. Distribution of Rebates, if any, to End-Users and/or <br /> installation contractors shall be according to the procedures in effect for other <br /> conservation and load management programs. The parties agree that LCRA may, at its <br /> sole discretion, change the rebate rates from time to time over the term of this Agreement. <br /> If rebates are changed, LCRA agrees that the newly adopted rates shall not take ~ffect for <br /> sixty (60) days from the date of adoption and will not be applicable to Improvements for <br /> which a request for payment has been made prior to date of adoption. <br /> (2) At least once a month, LCRA shall pay rebates to Wholesale Customers in response to <br /> each request for payment of rebate supported by an acceptable Inspection report. It is <br /> understood and agreed that if the installation of Improvements was, financed with a loan <br /> under the LCRA loan option program, no rebates shall be requested or paid with respect <br /> to such Dwelling. <br /> (3) Wholesale Customer shall maintain files of records and documentation supporting <br /> payment of rebates for at least 5 years. At the request of LŒ.A, Wholesale Customer shall <br /> make such files available for audit by an LCRA-selected auditor. <br /> B. OUTSIDE FINANCING <br /> (1) LCRA may negotiate a buy-down of current rate(s) offered by local financial institutions <br /> for home improvement loans. Wholesale customer agrees to inform end- <br /> users of procedures for applying for low-interest loans and sources of <br /> financing. Wholesale customer will verify that end-user's loan amount for <br /> buy-down of the interest rate only includes those measures recommended <br /> in the energy survey and at funding level limits not to exceed 25% above <br /> the estimated cost for each individual measure. <br /> INITIALED TO ACKNOWLEDGE ELECTION AND ACCEPTANCE: <br /> WHOLESALE CUSTOMER: LCRA: <br /> iff t.
