<br />64 <br /> <br />RESOLUTION 1992- 27R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE USE OF A <br />3 .5 ACRE TRACT OF CITY PARK PROPERTY FOR THE <br />CONSTRUCTION OF A PUBLIC LIBRARY: AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council has conducted a public hearing <br />on the proposed use of a 3.5 acre tract of City park property <br />for the construction of a public library: and, <br /> <br />WHEREAS, this public hearing was preceded by notice as <br />required by Section 26.003 of the Texas Parks and v'lildlife <br />Code: and, <br /> <br />WHEREAS, the use of a portion of Memorial Park for this <br />purpose has widespread community support, as evidenced by the <br />public referendum in May, 1991 in which the proposed library <br />use was approved by 75.4% of the voters: and, <br /> <br />WHEREAS, the City' s architectural consultants for the <br />library project have developed a site plan which will <br />minimize the library's impact on the surrounding park land: <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS: <br /> <br />Part 1. That the City Council determines that there is <br />no feasible and prudent alternative to the use of the 3.5 <br />acre site in Memorial Park for the construction of the new <br />library building. <br /> <br />Part 2. That the propos~d library project includes all <br />reasonable planning to minimize harm to the land as a park <br />resulting from the project. <br /> <br />Part 3. That the use of the 3.5 acre tract of Memorial <br />Park across from Hopkins Street and adjacent to the National <br />Guard armory for the construction of the proposed library <br />project is hereby approved. <br /> <br />Part 4.
