40 RESOLUTION NO. 1981-3R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING ACCEPTANCE OF THE COMPLETION OF WORK ON THE L.B.J. RE- LIEF MAIN IN SAN MARCOS, TEXAS, AUTHORIZING FINAL PAYMENT TO DU-MOR ENTERPRISES OF SAN ANTONIO, TEXAS FOR THIS PROJECT; AND ESTABLISH- ING AN EFFECTIVE DATE. WHEREAS, the City Du-Mor Enterprises, of a sewer relief main in Drive and L.B.J. Drive Texas; and, of San Marcos, Texas, has contracted with San Antonio, Texas for the installation of the vicinity of the intersection of Sessom in the City of San Marcos, Hays County, WHEREAS, the installation of said sewer relief main has been completed and Du-Mor Enterprises, on January 1, 1981, requested final inspection on said construction; and, WHEREAS, said final inspection was conducted on January 7, 1981; and WHEREAS, the Acting Directior of Public Works of the City of San Marcos recommends that the City Council accept the L.B.J. Relief Main for use by the City as of January 7, 1981, and authorize final payment to Du-Mor Enterprises, in the amount of ten thousand fifty dollars ($10,050.00); now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the work performed by Du-Mor Enterprises of San Antonio, Texas in constructing the L.B.J. Relief Main in San Marcos, Texas, be, and is hereby, accepted as being complete pursuant to the terms of the contract. PART 2. That the City of San Marcos is hereby authorized to make the final payment to Du-Mor Enterprises for said construction in the amount of ten thousand fifty dollars ($10,050.00). PART 3. That this resolution shall take effect immediately from and after its passage. ADOPTED this 12th day of January, 1981. Attest: Sharyl Werner Ci ty Secretary
